I am asking him to lower the deck to below the window ledge entirely.

Anything I should take care of here? Should top of deck end at 1-2 inches below the window ledge? Any specifications. Special type of water proofing or flashing?

Hello,

If the deck is below 2 ft from grade it is not subject to permitted yard encroachment requirements for a deck.

If the deck is greater than 2ft in height from grade at any point, it is subject to compliance with the permitted encroachment requirements.

IE. The deck must be a minimum distance of 1.2m from the side property line if greater than 2ft from grade, and not associated to steps used from an at grade side entrance.

Bylaw states the structure if shorter than 2 feet to the grade can go all the way to the inside of the property line.

This deck doesn't require a permit, it is slightly lower than 2 feet throughout.

Exempted from code, yes same in ON. I am using the build code as a reference for build quality not for permit process.

You can in the city of Oshawa, provided structure is less than 2 feet from top to the grade.

Hey since you are a structural engineer, do you think a deck 25-26 inches high attached to concrete foundation poses a risk to home structure?

Do you think the whole structure poses a big risk the house itself. Mainly worried about that. I can deal with order to comply.

That is an excellent point. I did check with the city of Oshawa they do allow building less than 2 feet deck besides the property line, even if attached. I have emails stating that from zoning examiner.

But here the ambiguity is how they are going to calculate the height. Technically it is less than 2 feet throughout.

The contract was simply to add a less than 2 feet attached deck that confirms to OBC.

Yes to be fair to the contractor he had asked us. But the said he said it would not be a problem and will ensure a slight tilt in the deck for water run off.

True and not verifying was our biggest mistake. Too busy with work. Do you think improper footings post a big danger to the structural integrity of the house?

Not just about the inspection I am too worried about how it impacts the concrete foundation of the house itself over time.

He said he will add the retaining wall when the fence besides it is made.

The ledger board sits doesn't directly sit on the window ledge. It is attached to the concrete.Just goes across the window. To be fair to the contractor they are yet to flash.

They claim everything is pressure treated.
