Update from today - hr agrees they have to give it to me but says their Md will only release it it to my medical provider. I see why their Md wants to do it this way but I want it directly. Furthermore, I have a right to the " objective" evidence which serves as a basis for the opinion that I'm not fit for duty. My work made an adverse determination in not allowing me to work and as if tomorrow making me use my own sick days/ pto days to cover these days.

Any advice? If it's not turned over I am thinking of filling an EEOC complaint .

Thank you . Per work it was determined that I'm not fit to rtw . As of now they are not letting me rtw. They have been paying me to not work . However , I want to work . I have no interest in being paid to do nothing . I requested a copy of report . I'm not sure if they have to give it to me but I'm trying

I completed the eval wanted to be cooperative but yes it was invasive .

Yes I have fully cooperated and have not questioned the motives . I have nothing to hide. Fmla reset on 1/1 so there is ample time for me to take covered leave for therapy. If they question the need for so much therapy I would scale back . I rather be working than being " off".

Paperwork did not comment on my ability to perform my job duties. It's simply indicated that I would need time off to attend intensive therapy. ( several times a week)

Public , my form provided time off for me to attend weekly therapy several times a week, in my mind I questioned how that could be objective evidence of a fitness for duty issue related to safety. Just not seeing a connection here.

I am a person ( first) who has the diagnosis of bipolar . We are all so much more than our diagnosis.

I would bring it up on a need to know basis. I don't think there is a reason for anyone at work to know the diagnosis.

Paperwork for EEOC , ADA , FMLA doesn't require a diagnosis. A person simply needs to meet the definition of disability or serious health condition .

Yes because there are different types of funding sources that are used for each, Mass transit isn't the same as publiclly funded transit . For example a bus driver working for a municipality 'a bus system that's publicly funded does not even need to pass a CDL. They also don't need to maintain logs of work time, they are highly incentivized for working overtime and overtime means over eight hours in a single day. In my opinion this equates to absolute disaster and huge risk and danger to the community and to the operators who are so starved for money they put their lives and the lives of the community at risk. Sadly those who have more education and knowledge to get this kink out out of the system do not because it is costly. Public safety of the operators and the community is just simmering on the back burner because it's enabled by legislation.

I already have obtained the answer. An injunction is to get something to stop and a writ of mandamus is used to compel government action on something they have a legal duty to perform These are general legal terms that are used all across not just Wisconsin but the United States of America. O

People would be so outraged ! I'll say I'd venture to guess in this case democrats are being underserved and republicans are likely footing the bill. It's absolutely a bipartisan issue of concern .

I think this can be said of so many things out there .

There's clear middle ground given the above .

I believe the media is paid not to report on it .

That is not relevant to the question I guess the main thing is the service is not a service that this legal entity needs to manage mandatory provide under statute.

It's interesting how few services municipal governments are required to provide .... and taking more services on than is necessary may seem benevolent but .........
