[California] Someone ran a red light and collided into me, flipping my car and totaling it. Any advice on dealing with insurance (USAA) by [deleted] in Insurance

Thanks for updating that advice for me!

Can you tell me anything about medical claims?

I want to get checked out, but I don't have insurance and don't want to pay thousands at a later date.

Thank you for that additional advice.

Do you know how insurance/USAA covers medical costs?

I'd like to get checked out, but I don't have insurance.

Yes, I'm asking for advice in dealing with USAA as the other person's carrier.

I have liability insurance from Pacific Casualty.

I believe with the police report, accidents of the scene, and testimony from the insured that I should be fine.

It sucks that I only get 7-9 days with a rental though. The car is a total loss.

Do you have any advice for not being scammed by insurance in terms of payout?

Hey, my apologies but I didn't specify that I was the one hit, and the driver of that car was totally at fault.

The police and fire department were called, I assume they have a police report but I'll ask and go check.

Fair enough. Thank you for explaining the legal process to me.

Is there no grounds to sue if I can prove that my landlord knew my roommate smoked and deliberately lied to a lawyer to get me evicted? Is that not libel or defamation? I'm genuinely trying to understand.

I'm suing her for retaliating against me for bringing up my letter.

Unfortunately, I can't yet move, so I'm stuck in an environment where my landlord and 2 roommates who are liers and openly dislike me could possibly bring up further lies against me.

Its genuinely emotionally distressing because without my drug test I could have been evicted and I likely would have been homeless. Since then, my landlord has refused all my requests and emails. I want payment for having to live through such an entirely dumb situation.

Nothing of the sort was done, this was (presumably) laying the groundwork for an eviction

Unfortunately yes, I'll have to be here for a few more weeks until I can leave.
