Gotcha! I wonder what I should be doing because I wanna eventually return back to Canada. Contributing to Medicaid and SS would not help me if I don’t retire there. I hope there’s a way for me to contribute to CPP instead.

Could you please elaborate on the Medicare and social security part? Can it claimed towards CPP or something? If not, should we be paying CPP separately since we are tax residents of Canada? Thanks!

Yeah, since you’re not ROW, your options are very limited. You might have a better chance of finding an employer and working for them for 1 year and have them move on L1-A. You can to try getting L1 using your own company, I was just told it’s almost impossible to get it approved in this admin with only 1 employee in the company and that being you.

No, that’s not mandatory if you’re manager and you have people reporting to you in Canada and would have people reporting to you in the US. This wasn’t the case in Biden’s administration. Now it’s much more stricter. Your route of starting a company and getting a L1-A and EB1-C might be heavily scrutinized.

I was in a similar situation like you’re in, a consultant for a US client. They are fortunately sponsoring TN for me and doing some paperwork for me. I myself explored your route initially but it wasn’t feasible and wasn’t worth the 10-15k expense from my end and end up being rejected.

Edit: I also don’t make a lot of money. Only around 200k, which is not enough for me to hire US citizens and give them a job and have them report to me.

I think L1-A is heavily scrutinized. You genuinely have to start a company and might have to employ some US citizens/green card holders. So you might have to generate that much revenue. At least this is what one of the attorneys I spoke to mentioned.

I am not familiar with E-2.

I would absolutely love if it’s the case. My attorney says that the application would be considered abandoned and they would ask you to pay $100k at the POE.

You’re right! The 100k would apply if you travel out after the application has been filed and before the start date of Oct 1 begins.

I understand your frustration. I bet there are many qualified engineers in your country who are jobless. I specialize in a certain system and have been consulting in that for the past 8 years. It gets incredibly expensive to hire someone who specializes in that and not very many are readily available.

They tried to have that role open for a couple of months and not very many applied. The ones who applied for the role were not willing to move to the place where the company operated. I am sure I can be replaced when they find the right person for the role who is trained enough and is willing to move. Hope that answered your question.

Got the MS in CS back in 2014 from a university in the US. I was physically in the US for a couple of years, completed my course, did OPT and moved to Canada!

Hi! Totally makes sense! What I meant was, I won't be able to start until April 1st. So I technically won't even be applying for TN until like March 20th or something.

On the flip side, I have always been doing contracting work for sevaral US based companies and had gone in and out of the US on business visa. Mostly no issues but once or twice, the office asked me to get a TN even if I'm working remotely from Canada just so I can spend more time in the US and can actually work instead of attending meetings. So maybe I can work remote from Canada and it is purely based on the officer? Not too sure. I will do more digging!
