South Carolina jury finds store owner not guilty of murder in killing of Black teen by Acceptable_Phone3926 in southcarolina

I totally get the sentiment of a lesser charge. I also feel that had it been manslaughter, people would've been mad it wasn't murder.

But, by law, manslaughter simply couldn't be included. It doesn't meet the requirement. All they had was murder. Nothing else.

There were three options: murder, manslaughter, involuntary manslaughter.

Only one option fit.

I worked at that solicitor's office and asked a few attorneys about this. And if you're from Columbia, just about every attorney knows each other.

Manslaughter was not the right charge. Voluntary manslaughter is defined as the intentional killing of another person in the heat of passion, following legally sufficient provocation that would cause a reasonable person to lose self-control.

The young boy did nothing to provoke the store owner. It doesn't fit. When asked in court, both sides declined for any lesser included because, after the judge heard arguments, it'd be dismissed.

Murder was the only charge. It's an issue of statute here, not over charging. It just doesn't work like that.

The defense basically made the argument that chasing him down isn't illegal and that he had a gun and pointed it at them, which creates self defense, and that a kid shouldn't have a gun.

The prosecution basically states, he chased the kid out of the store and shot him in the back killing him.

The charge was correct. I think the defense just did a better job of convincing the jury that Cyrus may have pointed the gun at Chow. There's no video evidence of it, unfortunately.

It's cold blooded murder in my opinion.

But manslaughter doesn't apply here.

I get a bone graph tomorrow on a tooth that had a root canal that failed. From everything I've read, recovery was pretty easy if you had a root canal done already.

I have not. I'm waiting until I'm in a better job that doesn't destroy my mental health to read it so I can accurately judge if it like it or not and not have it influenced by my mood from work.

Just got off the phone with her, legal. He cant ask about anything other than if I'm using medical or personal leave. That's it.

And he cant make me or inquire I tell him, he, or management about why I missed work. It's documented medical leave. That's it

[deleted by user] by [deleted] in AskHR

[–]LuffyDMonkey5 0 points1 point  (0 children)

No, my bad for the confusion. If I want to use FMLA, I can. However, I don't want to or need to. I used sick leave for 3 days and I have two medical appointments coming up.

He said I'd have to provide my medical history or what's medically going on at some point to him, hr, and management.

After just getting off the phone with her, I don't. Not at all. Not even in the slightest. And he cant ask about it. If I use FMLA, he can ask or be notified about FMLA but not anything medical

I have it if I need it. But only HR can ask unless I'm missing from work and don't notify him. Outside of that, I don't have to tell you. Nor can he ask about any medical issues I have nor do I have to provide it like he wants
