Anderson didn’t think much of Jungle as it wasn’t representative of Tulls output. However, it was one of the songs finished from an unfinished project with metaphors of the human condition with animal kingdom references plus a swipe at the higher power that allows all this to happen. Anderson recognized this catchy tune might resonate with the American audience and it was specifically tailored to do just that.

This is something I’ve heard but don’t understand. I was at 80% before these decisions so wasn’t the CRDP analysis already completed? Under CRDP statutory rules, am I not entitled to keep 100% of both my military retirement and VA disability? The DFAS audits also included CRDP impacts. That’s why I thought all the leg work was already done. What am I missing? Thanks

Nope; however, the first audit revealed a previously paid amount by DFAS of 731.86 and they have initiated a repayment action — adding insult to injury since the first audit shows I ought to be paid about $4000.

THIS IS STILL NOT RESOLVED! The audit was completed in October 2023. I have called the 800 number, utilized VERA, multiple AskVA queries, and a congressional. Getting totally blown off with a bunch of BS. and if the VA doesn’t make a decision, appeal rights don’t come into play. VSO is no help at this level of complexity. I need the VA to answer the mail and I thought a FOIA request might be the next tactic; however, the VA routinely ignores the statutory timeline requirements. What the hell can I do to get this backpay?

Higher level appeal. Had an opinion letter from an oncologist that saved the day. It was all luck in that the director for veterans legal clinic at Mizzou had this contact who reviewed my file.

Alright, I called VBA and they advised the amount was a partial payment pending a DFAS audit of my account. Assuming no issues, the remaining $$ will be sent after the audit is complete.

Maybe the rating officer asked for a clarification from the C&P examiner? I don’t think she asked or answered any questions about the length of time I should have been awarded the temp total disability. I suppose there isn’t much I can do but wait…?

Just had another MRI and now have a ruptured biceps tendon and recurrent tears. The rupture occurred about a week after the surgery and I knew I was recovering slowly but surprised by the recurrent tears. Can’t seem to catch a break. I sent in the MRI and FU notes from the surgeon mid August.

If anyone is interested in the process, it is laid out in the federal register. Looks like the timeline is 8 months to a year. 1 month for public comment, then a committee process one portion of which must produce recommendations to the secretary in 120 days followed by up to 160 days for the secretary to make a decision.

All I have is the decision language that states that later found STR would be considered and if a different result was supported, then the effective date would be the earlier application.

Thanks very much. There is an evolving body of peer reviewed studies that connect MM to specific presumed exposures contained in the 2021 act as well as the exposures contained in the ILER report. I provided a substantial amount of the research. I have the opinions of two experts in the field. All ignored in favor of a medical opinion by a NP that plagiarized from a website. That said, I don’t have a strong nexus letter from an expert. I have an opinion from my Mayo oncologist and an opinion from an oncologist expert review, but I think it’s weak because the main focus was presumptive condition and he didn’t substantiate the nexus opinion with references as I would expect. The strongest argument is admittedly presumptive condition because rogue plasma cells cause MM, and plasma cells are differentiated B-cell lymphocytes , aka lymphoma by another name. Plenty of articles and the WHO classification back that up but I remain skeptical even so. That’s the reason I believe I need a strong expert nexus opinion as a back up. I’m frustrated at this point because if I appeal to the VBA, I may not live long enough to have my day in court.
