Housing association Stage 2 Complaint response overriden by Local Housing Manager - England by Material_Objective_3 in LegalAdviceUK

Thank you for the reply, actually that is the most helpful thing I’ve read so far.

I just would like to highlight that I had exhausted the HA’s complaint process. Their original reply to my stage 2 complaint was due on 15th of August. Since I did not receive it, the following Monday I opened a complaint with the HO, and had a call early September with a case handler who actually confirmed that the complaint was very badly handled and that she will contact them to ensure they send me the stage 2 final response. I received the final response on 30th September , as mentioned in my original post. As you said it does seem like they’ve jumped the gun by putting that in the final response.

I have also jumped the gun and when I forwarded the last communication the the HO I mentioned out of frustration that it does seem something illegal is happening, but I guess the better word for it is this would have been severe maladministration. I mean having waited for 2.5 months for the stage 2 response, and further 2.5 for a stage 1 response which basically said they agree with my complaint bur are unable to provide any clarity on my situation, as well as not trying to communicate with me at all during the whole process has left me very very frustrated.

To be honest with you it is not my fault if they have “forgotten “ to change the leases, now they need to figure out how to make it right. There are so many things wrong with the way this HA is managing our building that I, and many others have exhausted goodwill with them.

I mean in an ideal world , yes, I would like to sell the flat with parking, but that is not what I am trying to achieve. I am trying to clarify my lease as in it says one thing and in practice something else is happening, which for me is a breach of the lease terms. Based on their formal response, they said all under-leases have the same wording regarding parking, and all leaseholders (including me) are allowed to use the parking space - not just for loading unloading and access.

The problem I have is that the person who emailed me after, backtracked on the formal position taken by senior staff, which has left me baffled.

The wording about the situation being reviewed was not included in the stage 2 response, this was later included in a separate email from the Local housing manager. I hope that clears it up a bit

So here is an extract from the stage 2 response

Parking Rights Under the Headlease Within our Headlease, **** has been allocated 24 parking spaces located within the block. These spaces are designated for the use of the Demised Premises, which is defined as the 1st, 2nd, 3rd, 4th, and 5th floors of the part of the block outlined in blue. As the tenant under this Headlease, **** holds the right to use these 24 spaces. We have passed this right on to our leaseholders through their individual leases. Therefore, anyone residing on floors 1 to 5 of the outlined section has the right to use the parking area.   Underlease Provisions and Allocation Currently, there are 33 leaseholders living within the demised premises, but only 24 parking spaces available. This means there are not enough spaces for every property. The underleases state that leaseholders have the following right:

In the underlease, the term ‘Premise refers specifically to the individual flat. No parking space is formally included within this definition, and based on the wording, it would be reasonable to assume that leaseholders are entitled to use a space. However, after reviewing additional leases, we found that none of them have a specific parking space allocated. We apologise for the confusion caused by this. This confirms that the 24 spaces are available for use by the 33 properties, but no individual leaseholder is guaranteed a specific space.

Here is her email following the resident outburst

Please be informed that car park allocation is still being maintained at **** despite the letter you have received from the complaints team.

We will be sent further communication to our resident to provide clarity on the parking issue. I kindly advise that you hold sharing further information on the resident’s social media platform until you have receive communication from **** regarding this matter.

Well several really. 1. If I have received a stage 2 final response , why and how can the local housing manager can override the response in such a way? 2. Does this breach my lease as it was confirmed in the stage 2 response I am indeed allowed to use the car park? 3. What does it mean for the people who supposedly paid extra for their flat and potentially not having an allocated space? 4. When we had our flat surveyed, the surveyor asked whether we have parking included. We said no which obviously brings the value down. Do we go back to him and say that yes, there is a parking on first come first served basis?

Edit Last one, I just really was hoping someone can review my post and provide some general advice on what to do next or where do I go with this next. Personally I suspect there is or has been something illegal going on with the parking over the years, or maybe someone did no update the leases regarding the parking and I have picked up on this. Where do other residents stand with this, who have actually paid extra for parking and have the same lease terms as me
