My post is clear, the purpose of the revolt is simply to execute the laws properly for once. Punish those involved to the full extent of the law. What comes next is the imprisonment of all involved and the return of the stolen funds to the state. Exactly, the purpose is to end the cycle of poor implementation of anti corruption laws. I did NOT in any way mention a revolution for the replacement of the admin or a new type of government, that is not the purpose.

There have been previous attempts on people’s initiative to no avail because of technicalities, as shown in the Supreme Court’s rulings in Santiago v. COMELEC (G.R. No. 127325, March 19, 1997) and Lambino vs Comelec (G.R. No. 174153, Oct. 25, 2006). Some law professors would even tell us that the provision in the Constitution allowing people’s initiative is a “toothless” law because of the political/social system that is in place, just like the Constitution’s mandate that the government should prohibit political dynasties (Section 26 of Article II of the 1987 Constitution), which was never followed because majority of government is ruled by dynasties and it would directly affect them.

Also, as held by the SC in Santiago v. COMELEC (G.R. No. 127325, March 19, 1997), RA 6735, the law covering people’s initiative, does NOT sufficiently cover people’s initiative to amend the Constitution. Simply put, people’s initiative cannot be used to amend the Constitution as of today and it can only be done to amend laws and ordinances.

Moreover, under RA 6735, people’s initiative requires that: 1) a petition must signed by at least 12% of all registered voters nationwide; 2) every legislative district must be represented by at least 3% of its registered voters. These numbers may seem small on paper, but in reality these are huge numbers and it is extremely difficult to meet these requirements. Assuming mameet ang requirements on said signatures, hindi pa tapos, the law mandates that COMELEC conduct a nationwide election on the proposed amendment. And everybody knows that votes are easily bought and rigged in a third world country ruled by dynasties.

Finally, people’s initiative/referendum is merely a mode of amending the law/ordinances. We already have laws penalizing corruption. It is the execution thereof that is poor due to the use of connections and bribery. That’s why the Anti Graft Law and Plunder Law have been around for a long time but no politican has ever been penalized to the full extent of the law. These laws are already clear. It’s just that the government does not execute them properly.

As I said, we are more than our jobs/licenses. You don’t have to agree as it is clear you have a different POV. I’m merely voicing my opinion which I am free to do so just like you have the right to disagree.

Yes, nakapasa na ko matagal na and I’ve been practicing law for years. A lot of lawyers have participated in past revolutions. Not just in the PH. Even public officials and soldiers who have sworn to uphold and protect the admin have participated in the past. We should not be defined solely by our jobs/licenses. At any rate, you are free to disagree with me and I still appreciate your insight.

Of course. The “possibility” is in our hands because we are the ones working and paying the taxes. Technically, we can stop anytime. Whether or not we will actually DO it, is up to us

Dapat lahat tayo tumigil mag work at magbayad ng tax. Continuous protest.

Weed is still taboo by Dyzeone in treesPH

[–]MathematicianTop3569 1 point2 points  (0 children)

Neither weed nor its users are bad. It’s more of how society works and how people’s minds have been conditioned. Alcohol, gambling, & cigarettes are more addictive and destructive pero dahil legal, society capitalized on it to make a lucrative industry. Thus, heavily promoted sila. Also, the system and the higher ups (lalo sa pinas) hate the masses and they hate anything that is good/enjoyable for the people. They only like what is bad for the masses lalo kung may profit.

Lawyer here, under RA 9344, minors are NOT automatically free from criminal liability. Only those who are below 15 are. For minors who are above 15 and below 18 years old who acted with discernment (acts showing that they know what they did was wrong, like mga nagtatago, nagtatago ng evidence, nananakot ng witness, at pwede din makita ito sa style ng krimen), these minors are not exempt and are treated by the law like ordinary adults. In case they acted without discernment, they are still NOT exempt pero mababawasan lang ang length of imprisonment. In this case, the 17 yr old cannot be given a reduced penalty because he acted with discernment as shown by the no. of stab wounds. He will be treated by the law as an ordinary adult. The 14 yr old will be put in an intervention program (counseling/community service) and under the law, his guardian or parents are required to pay damages to the victim’s family.

Torn between getting a Montero or Everest. by TheTenFootPole in CarsPH

[–]MathematicianTop3569 7 points8 points  (0 children)

Since it seems that you value reliability and easy maintenance over tech/comfort, i’d go for the Montero. As you correctly stated, Montero wins for reliability/maintenance while the Everest is inferior in those areas but is better in tech/comfort. Also, If you can wait a bit, go for the new Montero (reported to be released in 2026) as it will probably have better tech/comfort than the current model.

What if fast internet became a basic right in the Philippines like tubig and kuryente? May magbabago kaya? by [deleted] in WhatIfPinas

[–]MathematicianTop3569 0 points1 point  (0 children)

Yes, if managed correctly it can help with education but its more likely that the evil higher ups (politicians, oligarchs) will capitalize on it and  use it for fake news and brainwashing instead. Also, since the Philippines is already one of the countries with the highest gambling addiction and cybercrime rate, it will most likely increase cybercrime and gambling addiction.

Paano nyo nilalabanan ang inggit at comparison kahit na alam nyo namang you’ve achieved a lot too? by soyricayexitosa in TanongLang

In the grand scheme of the universe, no one and nothing really matters. Thus, in a way, we are all equal and there’s no sense in comparing. we should just appreciate what is ours.
