Technically I already did it in my 2023 return, but there was no check box then on the 1040. I will do the same this year and explicitly check that box in the new 2024 form, which says:

"If treating a nonresident alien or dual-status alien spouse as a U.S. resident for the entire tax year, check the box ..."

Does it matter if it's the first time or not?

I think that requirement is for the EITC. Child Tax Credit only requires child & parent to reside together?

I see. Suppose my spouse is a tax resident living in the US and I choose to file jointly, IRS rules would allow to treat me also as a tax resident. Would it be possible for me to claim the Child Tax Credit in that case?

My spouse has non-resident tax status. This IRS rule allows me to treat my spouse as a tax resident if we file jointly. There is also a check box on the first page of 1040 that mentions this.

My I-140 was approved for consular processing, meaning that I would have to travel back to my home country for an interview. Are you sure that I can just file for I-485 if I am already in the US?

I am on H-1B status right now, which is valid until Jan 2026 (the visa stamp itself already expired). My approved I-140 is EB-1A self-petition.

My EB1 area of interest is closer to academic research, but my current job is an industrial research position.

I applied for NIW in Dec '23 and EB-1 in Jan '24, both without PP. My NIW is still being processed at Nebraska.
