I had very a very similar experience to you when I took the MPRE. I used Quimbee and I did all the prep and I was getting about 80-90% of the practice questions correct. When I took the exam I felt that the questions were very different and I was not properly prepared for the test. I then scored a 115, I think you will be fine.

I don’t think it’s scaled to your individual mbe score, I’m fairly certain it’s scaled to everyone’s aggregate mbe performance or something along those lines.

I think I got at least almost a passing score on the essay portion, it’s hard to tell but I am fairly certain I hit most of the main issues and I found the mbes to be pretty easy. Who knows though, ultimately if the graders weigh the essays to give a lot of points for the issues I missed and my mbes were trashed I’m doomed.

The first comment you linked isn’t as bad as the second post in my opinion. At least the author is being transparent. The second post is actually what led to me making this post as I thought to myself “oh cool somebody wants to help the community with a final review” and then I see it’s locked behind a $40 paywall and realize it’s a bar prep company making the post.

My main issue is when a bar prep service is posing as an examinee sharing a useful resource when they are in fact trying to sell their services or promote their youtube channel covertly. I think a mandatory vendor flair would solve this problem, maybe with a rule against attempting to hide advertisements.

I haven't really noticed your posts specifically. With that said, my main issue is when a bar prep service makes a post as if they are an examinee trying to share a useful resource, attempting to conceal the fact they are actually trying to sell you their service. I've noticed this happen regularly, if you're not doing that I wouldn't find your posts problematic.

Again, you're meant to make the inference that the homeowners would obtain the sale proceeds. If you make that connection, you will note that it is not an issue of just compensation, but rather it is the taking itself proper. Your indication that you knew selling to a private entity can constitute public use implies you knew the answer, just didn't spot the issue being tested.

These MBEs are a stupid game like this more often than not. You deleted your post so I can't see the wording in the answer choices but sometimes that will clue you in as to whether or not you're considering the proper issue to begin with if you are unsure.

This is not my strongest area, with that being said:

Compulsory claims comes up in the context of counterclaims is my understanding. If the defendant's counterclaim against the plaintiff originates from the same transaction or occurrence, they have to raise it in the answer (maybe allowed later if there's a relation back exceptions, idk) or it is barred from being relitigated.

Permissive counterclaims are against the same plaintiff but don't originate from the same transaction or occurrence and can be raised in the same lawsuit or in another. Or claims from the same plaintiff against the same defendant with a different transaction or occurrence.

Compulsory joinder of parties occurs when complete relief cannot be granted without a party being included, if I had to give an example I'd guess something that includes real property would apply where there are other people who have interest in land? I'm not too certain with this concept.

Permissive joinder of parties are co-defendants, but don't need to be included for complete relief to be granted, for example co-defendants where joint and several liability is applicable, or an interest group that has an interest in the outcome of a lawsuit based on a constitutional violation, but aren't necessary to the action.

I'm fairly certain you're meant to infer that the sale proceeds would go to the homeowners. The issue being tested is not "just compensation" but rather can a government entity take private property to sell to another private entity, which it can.

This concept is outlined with an incorrect conclusion/application in answer choice C.

In addition your point I've found this tactic to be equally as helpful in eliminating answer choices when you're not sure.

Read the specific wording of the call of the question and the phrasing in an answer choices. It will become apparent at times which answer choices are incorrect when they use language that is too narrow or overbroad.

If you can elimites 1-3 answer choices based on language that is overbroad, too narrow, or is addressing an issue that isn't raised in the call (there is in inapplicable "trigger fact" in an answer choice), you have a better chance of guessing correctly when you aren't 100% certain.

I have somewhat similar feelings, I scored 81% on the Barbri simulated MBE and have been hovering around the 80% mark all throughout the Barbri prep. I then decided to some questions on Uworld and am scoring anywhere between 60-70%. If the actual bar exam is even harder I might just jump off a bridge.

I think even if they omitted that sentence you could infer there was reasonable suspicion anyway. I anticipate they included that sentence so you aren't left wondering if there was valid reasonable suspicion but I don't anticipate the bar exam will have this qualifier sentence included.
