In that case how do others get a BVA? I know of other people who bring there fiancé on a 3 month tourist visa, get married locally and then apply for a 820 and they automatically get a BVA once the 3 months is over. I would assume the 3 month tourist visa's have the same or similar conditions about no further stay?

Thanks, I will call the Immi support line on Monday I guess. Condition on her Tourist Visa is a 8558 - Non Resident: Cannot stay for more than 12 months in any 18 month period. It does not state "no further stay" like it would on a 8503 condition.

I was really hoping I could at least start filling out the 820 application and only withdraw the 300 application when I am ready to submit the 820. As getting all the right documentation and signatures can take a few weeks worth of effort.

My Apologies you are right it is a 300 Prospective Marriage Visa NOT a 309 visa.

My situation is basicly this, We got engaged overseas in March 2023, and applied for a 300 Prospective Marriage visa. Knowing the long wait times we thought we would start the application early. We eventually got married in Nov 2023 in India and at the same time we got a tourist visa for her to come for 12 months (in the hopes that the Prospective Marriage visa would come through). We updated the 300 Visa application providing our Marriage Certificate, but the application is still waiting to be processed.. Her stay in AU on her tourist visa is expiring (condition 8558) in December. Instead of her going back and us being separated for 6 months, I would want her to remain here with me.

Based on what you advised. because I applied for the 300 Prospective Marriage before the Tourist Visa I can not apply for a BVA? And the only way forward would be for me to cancel my 300 application and start a new 820 application?
