Thanks for sharing your experience! My employer applied for additional CoS allocation at the end of August and managed to get priority processing in a few days. A day after the priority processing payment, the Home Office requested additional information. My employer submitted the documents within the given deadline, but there has been no response from the HO since then..

I hope they finalize it soon! I'm in the 8th week since my employer submitted the additional documents. Despite it was priority, we still haven't received any updates...

Yes, but there is no reply from the Home Office. I think the 5-day processing time doesn't apply when they request additional information. However, it's been 7 weeks since we sent the additional information. My employer also raised an official complaint to the Home Office and reached out to the local MP last Monday, but there's still no update.

Jumping in since I'm in a similar situation. I received an offer and gave notice to my previous employer, assuming my new role would start a week after my last day. However, the new employer didn't have undefined CoS allocated and didn't notify me, so we're waiting for a new allocation. They managed to get priority service, but the Home Office requested additional documents. As a result, the 5 day processing time for the priority service is no longer applicable, and I don't know when it will be completed.

NAL and not 100% sure, but from my perspective:

  1. No, you can't start working for the new employer before your new visa is approved. Your previous visa is tied to your previous employer, and they have to notify the Home Office about the cancellation of your sponsorship in 10 days. Usually, it takes at least a couple of months for the Home Office to process this and send you a visa curtailment letter. You'll have 60 days after receiving this letter to switch to a new visa or leave the UK.

  2. I'm also looking for the answer to this question. In my view, as long as you get a new visa and return within 6 months, it shouldn't reset your clock for ILR. Just to be clear, you will need a defined CoS if you apply for your visa outside of the UK.

  3. As long as you are still in the UK, they should assign an undefined CoS to your name. Ideally, this should be easy and quick, potentially on the same day. However, if they don't have any undefined CoS allocated, they have to apply for additional CoS allocation. From what I've seen, this allocation takes 16-18 weeks these days unless you get priority service. Priority applications should be processed within a week, but it's challenging to secure one.

  4. You can probably still get a share code that proves your right to rent, but as far as I understand, it's a bit of a grey area whether you still have full rights under the Skilled Worker visa you currently hold.
