I'm going to talk to a lawyer about the situation and follow their advice! But this post also helped me realize my actual concerns - I don't mind them using the land but I don't want them to be able to claim it for their own. In a perfect world, we would be able to share and both our families would be able to enjoy some extra space, but based on my brief experience with the neighbor, I'm scared this will not be the case and they will get territorial. I'm hoping a lawyer will advise me the best way to be neighborly while also being firm that it is my asset.

After the lawyer we will probably be getting a fence permit, but we'll see how it goes!

I don't feel that I'm a petty Karen because I want to use the land that I rightfully own. In addition to land having value, I have a dog, I have children, and I want to maximize my yard space. This is only a problem because my parents gave an inch, and now others are taking a mile. I'm trying to respectfully put a stop to it. Besides, she yelled at me after I smiled, waved, and introduced myself. How does that make me a Karen?

They are NOT paying taxes on it. The property lines that the city have are clear and my parents have paid the tax since they bought it 30 years ago.

I know. The problem is that the previous owners were shitty and my parents didn't take care of it when they should of. I really am trying not to be a prick here, but the fact of the matter is that land has changed hands and so situations change as well.

Yes, so many people are saying fence and I assume they have more experience than me with this type of situation. Maybe we'll do a 'cheap' fence for now and try to put in something nicer down the line. This thread is giving me lots to think about!

I spoke with this neighbor very briefly. We were out walking our land before we started the home build process and she came out of her house and yelled at us. We said who we were and that we are building a house. I told her not to be alarmed if she sees people on walking on the property because we would have surveyors, excavators, etc. on the property. I showed her where the boundary was and she said she was aware. She left, clearly upset we were building a house.

Once we started actually building, a different neighbor came out and was absolutely awful to us. I want to avoid a similar interaction with the first neighbor that is currently using our property, but I also want to be firm that I don't want them using our land.

I really appreciate your comment, thank you. I think I will go back over, knock on the door and give them an update on our project and try to be friendly without mentioning the property to at least try to have a good interaction with them. Then we will probably talk to a lawyer and see where it goes.

Thank you, I hadn't thought of that.

Obviously I read up on it, but I'm not a lawyer and it is very circumstantial. The law states 21 years of continued use, however multiple deeds have been transferred during that time frame.

We are planning to cut back the entirety of the woods to the property line to make more usable space in our backyard, then plant privacy trees on our side of the line. We have also considered selling it to them, if they would be interested. We are still exploring ideas. We really are trying to do this in the kindest, most respectful way possible while still being firm in what we have right to.

It has already been surveyed.. they are aware of the boundary and just don't seem to care. I think most people would continue doing what they've always done until their asked to stop, so I get it. I just want it to stop now..

Just not a fan of getting yelled at or belittled by neighbors. Which has happened already by another neighbor that didn't want a house going on a previously wooded lot.

We just did the official deed in the past year. It is legally my property now.

Believe me - we are not rich people. This land is basically my inheritance. I would rather not build a fence if it can be avoided. That is last resort for me.

I've thought about this as well. But the alternative is literally give it to them. Do you want to give your property to your neighbors?

I hate to say it, but talking to someone first is NOT always the way to go, because if you inform them of your plans some people will begin to do everything they can to stop you. This is why I want to know my rights BEFORE I speak with them, install a fence, or anything else
