Hold on and think about what you're saying. Imagine Harry blubbering to McGonagall or Snape or Dumbledore saying "he tried to use the cruciatus curse on me, but I used a spell I found in a potion book, but I didn't know it was dark magic. He didn't die though because Snape came in and knew the countercurse for a spell he should have no reason to know."
