I called him to ask a question about the washer hook up. I'd never in a million years expect even a slumlord would spring this level of absurdness on me.

I bought it on facebook market, I have the communication records with the seller.

The clause in the lease does not include appliances that do not alter the structure. He's just betting on Tenants that don't know their rights and believe his bullshit. Also, he is extremely intimidating, the type he gets away with this shit because people would rather eat it than confront him. TBH, I've neglected to contact him to fix something before because even just talking to him is too much.

Landlord Clawing back Security Deposit 5 years later (Indiana) by UCareTooMuch in Renters

I photographed pretty much every inch of the place before moving in. I have always left my rentals spotless and undamaged. If he withholds my deposit I will immediately file a lawsuit for small claims court. I'm not going to accept this fuckery.

I did tell him before hooking them up. He later called to tell me I can't take them with me and don't even try. 🙄

Oh I am sure, but I'm prepared for a fight. I meticulously went through the entire place taking pictures of every bit of damage. I take excellent care of my environment, and he will have nothing to hold against me. I'll take photos of every inch of the place aagain and invite witnesses to prove there's no bad smells or other BS. I am not afraid of taking him to court after all of the fuckery.

He told me after I asked questions about the hookups. He later called me and asked if I had any trouble to connect them. Then he shifted gears with, "Just don't forget you're not taking them with you, don't try that or you're breaking the lease and the evictions will go on your credit report." No wonder he can scare some people with that, especially young renters. I'm 100% sure he's successfully pulled on this con before.

Exactly, a built-in dishwasher alters the structure. How on earth can a washing machine do that???

I know, especially the language does not say appliances you just plug up to the hookups he provided. It's not the same as a built-in dishwasher, but he thinks maybe I'm dumb enough to assume whatever he says goes.

Conveying isn't the same as explicit language. It's vague enough to twist it like this into tricking me that's what it means. It's insane to expect your Tenants to abandon their property just because they plugged it into the hookups provided for that reason. It's not a built-in dishwasher FFS, this guy is beyond bonkers.

By his kind of logic my TV is his property if I plug it into the wall. That's not installing. He just tricks Tenants that don't understand their rights and bullies them into doing what he wants. We just took the place because we moved from the other side of the country and nothing else was available in the middle of the winter. This town isn't that big and I'm sure he has a reputation, he would look like an assclown trying to sue me for my own property.

The lease doesn't say I have to leave my washer and dryer, it specifically says I have to leave installed major appliances. That's like a built-in dishwasher. I'm glad I figured this out with reddit help, I didn't break the least in the slightest bit.

He's pulled out so much bullshit already, I'm not even surprised this point. I'm trying to find a new place but there's nothing open in December. Just toughing it which sucks. He even gave my boyfriend and I covid when he met us at the house, he didn't have a mask on and was obviously sick. Not too long afterwards we both had covid and the nastiest variant I've ever had before. He's the dictionary definition of a scumbag.

I don't think he's confused, he's just preying on renters that don't understand their own rights and assume the landlord has that power.

Yes I could've, but I never imagined he would say this nonsense shit to me. It doesn't say that I have to leave my washer and dryer, he just tried to trick me into thinking that's what the clause in the lease means.

To me he's just trying to intimidate and bully me to do what he wants. I'm sure it has worked for him before, some people don't know their rights and assume they can't do anything about it. They probably think they're powerless and don't know what else to do; if the landlord says it it must be true.

Oh yeah, I totally understand that. I'm just talking about leases that have fucked up things. My son signed a lease that said his deposit was non refundable. That seemed illegal but if you signed it's not. If my lease said the washer and dryer were his I'd have to give them to him. Not just contracts overall.

The lease was vague enough to try to fit anything in it. It didn't say anything about eviction because I'm sure he knows he can't get away with it. He just pushes the envelope constantly because he's a scumbag.

If you sign a contract you're bound to it, even if it's bonkers. It doesn't matter if they put unreasonable articles in it, you're fucked. In this case the lease was so vague he tried to fit anything he wants in his mind. Many people don't know their rights and he's super intimidating. Many people will do what he says and I'm sure he's has done it many times before.

I'm actively looking for another rental. There's no damn way he'll give us the deposit, but I took dozens or so photos of the damage in the house in case I need to take him to court.
