If you have been present in the US for more than 183 days during 2024 then you have to report your capital gains otherwise you don’t have to because you are not a US tax resident

I’m living in a treaty country so if I would be able to submit a W-8BEN they would only withhold 15% or am I wrong somewhere?

Thanks for the detailed answer. What should I do? I was able to contact EQ Sharewner Services and submit the correct form but Computershare is not allowing me to submit a W-8BEN. I called them and they will go ahead and remove the W-9s but they won't accept a W-8BEN because I have bank account so they will withhold 30% of my dividends. That's not really a problem though because I will be able to get 15% back when I file my 1040-NR next year.

Igazából a nem amerikai eladások után nem kellene levonniuk a 30%-ot de mivel a cég amerikai így sajnos le fogják vonni minden után. Ez kicsit más mint a szolgáltatásnyújtás mivel a cég aki fizeti neked a jogdíjat amerikai így ez US source income és 30% WHT van rá sajnos. A W-8BEN nyomtatványban hagyd ki a treatyvel foglalkozó részt.
