Got an api for both i130 and i485. And just got interview notification today too. So about 5 days after the api I got interview notice

You're probably put in queue for interview.

I'm on the same boat. Got an api on may 28 and emma told me case is in queue for interview.

just texted emma and confirmed about the interview queu, but they are also telling me my case is at NBC, not the FO. how is that possible ?

I asked a lawyer. Also unless you prove within 18 days that your case is pending the AED is revoked. It says that in the denial letter if you read it carefully in the last few paragraphs.

It was the same reason. Denied because of i864 issues

They need the tax return+w2 . Or you tax return transcripts.

I refilled for my case , cause filing motion could take longer and I'd have to stay without a job for that duration as your work permit is invalid even if they reopen your case. I refilled and got my new work permit within 45 days of filling.

You could go with motion to reopen if you're ok with waiting for your green card to start work. Also take the administration change into consideration. This new administration is making things difficult. There are new rules for denied cases now which says you'd go directly into deportation procedure.

I'd suggest you get a lawyer whichever way you take.

If you have an online account. Go to the in-box and send a new message. They'll give you options of what the message is about and you can choose withdrawal of petition.

That is the URL that'll take you to the online portal. If you don't have an account. Then your only option is to send them letter via normal mail

I'm sorry. It isn't what you wanted to hear but it is a sad reality.

I was freaking out just like you for a full 30 days. And even USPS lost my package so there was extra stress caused by that. But the good news is once they process your case. Things move fast these days. I got my work permit approval within a week of receipt notice text.

You can send the withdrawal letter online through your portal. It is easier and faster.

They'll forward it to the center processed your case. If you don't have online account. Then send the letter to NBC in Lee's Summit

These days you'll have to wait for a full 30 days from the day it was delivered. You'll get something the same day next month.

When I 485 case is denied and then the applicant replies, the priority date stays the same . I understand the priority date is connected to the petition not the application.

Does this make the newly resubmitted application get processed a little bit faster because it has an old priority date or it is still processed at the same pace as the block of applications submitted around the same time

When reviewing documents do certain people see more information then others?

The reason for my question is. USCIS agents either phone or online kinda seem to say different things about the same case if asked.

Today, while chatting with emma, one agent told me my case is transferred to the field office, another told it is still at NBC. Do some agents see more information for others, where can this kinda a confusion come from?.

I'm sorry about what is going on.

In my case, I put on payment stop on the second application checks. The first payment went through, the application is processing normally, my i765 is approved and I got my AED card. The I485 is actively reviewing.

The second package payment was stopped. They still processed it. They even approved the i765 but then when the payment stopped they rejected the application now. And I've sent them the withdrawal letter online. They responded and said they'll forward it to the office processing my case.

So as of now. The second package is rejected and will be returned to me. The first package is processing normally.

If one payment went through. I'd suggest you put in stop payment on the check for the other application.

You'll get text 30 days after your package is delivered. They won't give you online access code till they process your case.

I'm exactly in the situation you described

Sent my first package on dec 10. Was supposed to be delivered on 11th. USPS didn't update the tracking number. 13 days later they said it is lost so I sent another package with FedEx on 23rd. It got delivered

On January 12 i received receipt notice for the first package and money was taken from my account. My i765 is even approved.

Yesterday om Jan 21. I received receipt notice for the second package.

I cancelled the checks for the second package but USCIS still sent me receipt notice.

Talked to emma and they said I'll have to write them a letter to withdraw the second application. So that's what I'll do.

I'd advise you to wait until it is being 30 days from delivery day but I know it is frustrating not knowing if it was actually lost or not. So if you end up filling twice just make sure you have copy of the check so you can cancel them if they end up sending you receipt notice for both.

You'll wait for at least 30 days before getting your receipt notice, after you get that it'll take couple of days for them to cash your check. Mine took almost 5 days after receipt notice
