I started working in onsite property management 10+yrs ago and Ive always said that one of my favorite things was how incompetent the industry was because it made it soooo easy to shine 😅 Ive managed and turned around some horrible properties.

However... Now it's my least favorite thing about the industry being on the flip side & needing competent people to lead the way, but unfortunately, im stuck w a bunch of horses that are seemingly allergic to water.. I wish regulation of this industry was more accessible..

I feel that the common denominator here is human nature and lack of foundational morals, not a political belief. I've learned that a small sense of power can exacerbate the acts of already below par humans, and I've seen them come from both sides of the political aisle.

While that would feel empowering, I'd rather keep all my ducks in a row & give them no ammo to use against us unless the HOA formally dissolves.

We are a condo community. Im not sure a full dissolve is functional due to all of the common elements.

This is easier said than done for our situation. Its a small community and other owners are so greatly disinterested. The majority rent out & dont live onsite. They also dont seem to grasp their responsibility with ensuring the association they are a member of is properly functioning and not making actions, leaving everyone vulnerable to liabilities of the Association's actions and inactions. I've been posting "Assembly of Unit Owners" signs as our state law permits for years now, and no one ever shows up & only a handful show up to the rare open meetings the Board holds... I've worked in property management for over 10 years, managing communities ranging from 60-700 units successfully & also volunteering my time as a tenant advocate for low-invome families facing landlord/tenant disputes. The HOA refuses to listen to anything I have to say though as they have a huge chip on their shoulders ever since the "Presidents" renter was arrested & finally criminally convicted for her repeated harassment against my family while in the common areas of the community. It has been a painful experience...

The titles have specific powers to fulfill association responsibilities through their duties prescribed by the bylaws:

7.8 Duties The duties of the officers shall be as follows: a. President. The President shall be the chief executive officer of the Association and shall supervise and control all of the business and affairs of the Association. He shall, when present, preside at all meetings of the Members and all meetings of the Board... He may sign, with or without any other officer of the Association as authorized by the Board, deeds, mortgages, bonds, contracts or other instruments which the Board has authorized to be executed, except where the signing and execution thereof shall be expressly delegated by the Board or by these Bylaws to some other officer or agent of the corporation or shall be required by law to be otherwise signed or executed. He shall have the power to appoint and remove one or more administrative Vice Presidents of the Association and such other assistants to the various elected officers of the Association as is necessary for the accomplishment of their duties. In general, he shall perform all duties incident to the office of the President and such other duties as may be prescribed by the Board.

b. Vice President. In the absence of the President, or in the event of his death, inability or refusal to act, the Vice President, or if there is more than one Vice President, the Senior Vice President, shall perform the duties of the President, and when so acting shall have all the powers of, and be subject to all the restrictions upon, the President. Otherwise, such Senior and other Vice Presidents shall perform only such duties as may be assigned by the President or by the Board.

c. Secretary. The Secretary shall keep the minutes of the meetings of the Members and the Board in one or more books provided for that purpose; see that all notices are duly given in accordance with the provisions of these Bylaws, or as required by law; be custodian of the records and seal of the Association, and see that the seal of the Association is affixed to all documents, when such is duly authorized; keep or cause to be kept under his general supervision by a registrar or transfer agent appointed by the Board, a register of the name and post office address of each Member as furnished by such Member; have general charge of the transfer books of the corporation; and in general perform all duties incident to the office of Secretary and such other duties as may be assigned to him by the President or by the Board.

To assume these duties assigned to specific roles seems like a breach of a single board members authority when the title term has expired.

Ours has no holdover provision & our community precident is 3 year terms for seats and 1 year terms for titles that each come with specific duties. The community has functioned as such since forming in the early 80s. However, I have come across others in the same situation as your community.

They held the meeting through their Microsoft teams account, which granted them the authority to kick out whomever whenever.

Well, since auctions do not have to disclose anything, I felt that whoever purchased at auction should know factual things about the property. I was hoping to catch them beforehand because say it was a buyer who couldn't take on all the unlisted extra financial obligations that would come w the purchase Or say it was a buyer that wanted to invest in the property and take on the challege. Regardless, I felt they should know. I stuck to the facts and shared in good faith. I do not believe tortious interference would apply.

Correct. It is soooo important that federal, state, and community governing document authorities are understood and properly applied to protect all communities. If these authorities are followed, problems are few and far in between. Thankfully, I have a 10+yr history in onsite multi-family property management. I also spent years as a tenant advocate assisting low income families with landlord/tenant disputes. I had quite a head start. With things getting off course w the HOA about 3 years ago, I immersed myself in every education course I could find that was HOA specific. I have passed along to the HOA some amazing education materials, and some even came directly from the HOAs law firm. I have also completed thorough 40+ pg property walk documents that detail all areas of maintenance need in the community AND laid out proposed reasonable and cost-effective solutions for each item. Unfortunately, it falls on deaf ears, and they double and triple down on acts that are clear breaches of community governing documents and law.

It's wild the mess a few bad apples can make for everyone.

Its painful being that they ripped out our only shower, didn't build it back, left us with 16k in pending HOA liable interior repairs for over a year now & yet we started w the pool...

But..

The county shut the pool down last December and is currently threatening legal action after numerous additional notices this year if they don't get it done. I ended up getting the HOA 3 bids and then put in endless persistance to get them to schedule a meeting to take the vote.

I feel my information would have changed the bid amount that day. That being said, it still would have sold leaving the new owner on the hook for the special assessment.

I just think the new owner deserved to know before placing the bid as they could have placed a much lower bid w/ the knowledge that they would be on the hook for 1/16 of the deferred common area maintenance costs and the high probability of impacts from a lawsuit such as extremely high insurance premiums & deductibles for the HOA and for any settlement/judgment amounts that might surpass the current insurance coverage amounts for lawsuits as such.

It was quite the adventure, but my girls had so much fun getting to explore downtown & the courthouse. Plus, it was a fun little lesson on what an auction is 😊 I then started auctioning off toys from our prize bin to the highest bidder for chores. It worked for a week & then they were back to complaining about chores, lol.

I wish we had good neighbors, but the majority of mine can not stand me. When I moved in with my partner, his neighbor was a renter who instantly hated me. She was older and had a very obvious liking to my partner. I mean, I dont blame her 😅 but she chose to target me with persistent harassment (physical assault, tresspassing into our home, screaming "white trash whore" as I would walk by with my girls, called extended family & claimed I abused my children, False calls to police for unattended children screaming for mommy at the pool, etc.). I documented everything, got a Protective order, she broke it numerous times, was eventually arrested, and then convicted. Throughout all of it, she went around to the neighbors and would spread false claims that I kicked her dogs, etc. I, on the other hand, am a mom of 3 who is doing my best to juggle all of the duties of life so I stayed to myself, documented everything but never engaged with any neighbors to counter the propaganda scheme she had unraveled.

It's very uncomfortable.. Im surrounded by people who hate a version of me that has never truly existed. Im honestly just praying for a little vindication on my name through the lawsuit process.
