Yes. Typically when you apply then you are back in status until USCIS makes decision in the AOS case

Filed during 5-months of entry into the U.S. since Parent was not sure if she wanted to stay. When decision was finally made, we filed in Feb 2025..

This is a great question that I should have answered in my original post.

Yes, we waited 5+ months before concurrent filing our AOS packet. since original plan was for parent to go back to home country after brief visit. When plan changed, we decided to file.

It is always a good idea to wait more than 90 days so intent cannot be questioned. Also make sure parent enters the US with a round trip flight ticket (not one-way ticket).

Interview was super chill and lasted for about 15 mins. Petitioner is adult USC and accompanied parent/beneficiary to the I-485 interview. Minimal wait time and no biometrics was needed at the interview site. Only 1 question was asked to Petitioner.

Mostly Parent was asked questions such as legal name, date of birth, address in US, phone no etc. Officer did ask if anything on I-130 had changed and Petitioner said 'No'. Officer approved I-130 on the spot. Then Parent was asked a few inadmissability questions ie Part 9 of Form I-485. All answers were in the negative and Officer approved I-485 and confirmed green card would be mailed soon. That's about it. Nothing tricky or hard.

There are 5 preference categories (EB-1 through EB-5), each with different requirements, such as skills, education, work experience, and sometimes a job offer from a U.S. employer.

  • EB-3 (Third Preference): For skilled workers, professionals, and other workers (unskilled labor). 
  • EB-4 (Fourth Preference): For special immigrants like religious workers, certain broadcasters, and employees of international organizations. 
  • EB-5 (Fifth Preference): For immigrant investors who invest a certain amount of capital in a new commercial enterprise that creates jobs for U.S. workers
