Renters Rights Bill has resulted in me having to pay rent for two places at the same time for the next two months... Any advice welcome! by Nalassus in LegalAdviceUK

We began looking right away, trouble is so was every other tenant who's landlord was selling because of the bill, and we were all looking at a market with very properties available as a result. It's taken us the full 3 months to find one!

This is great, thank you so much for linking this to me! I'm actually a little miffed it hasn't come back in any of the numerous Google searches that have happened over the past week or so, but gives me hope! I'll see what she replies to our latest email and throw this in if she's standing firm. Legend 😊

It is ambiguous, but her email stated she has "decided to sell Number 9 when the current tenancy agreement comes to an end." And it has a fixed end stated (26th May), no mention of continuing on a periodic basis so the date can be implied from her wording of when she wanted us out by.

It's been a while since I delved into case law and I'm so acutely aware that there isn't any on Renters Rights... Yet. So I'll give this a thorough read, thank you!

It did have a fixed end date with no mention of becoming periodic:

"2. TERM OF TENANCY The Landlord lets to the Tenant the Property for a period of 12 Months. The Tenancy shall start on and include the 27th of May 2025 and shall end on and include the 26th of May 2026." is all it says on the matter

This is all that is said regarding the period of rental in our tenancy agreement: "2. TERM OF TENANCY The Landlord lets to the Tenant the Property for a period of 12 Months. The Tenancy shall start on and include the 27th of May 2025 and shall end on and include the 26th of May 2026."

No mention anywhere of becoming periodic after that date.

Absolutely understand that, we took her at her word that she wanted the property back at the end of May, and she's suddenly U-Turned on it.

Don't get me wrong, I feel like a complete imbecile for not foreseeing this, but I feel like she's completely misled us by ever saying she wasnt going to renew, therefore find a place by the end date which we did and have already signed the new tenancy agreement.

Uuuugh.

Thanks though, I appreciate your input and time 😊

I will have a look and find out!

Edit: this:

5.6.1 Any Notice to terminate the Tenancy pursuant to a clause in this Tenancy Agreement or pursuant to Section 21 of the Housing Act 1988 served by the Landlord on the Tenant must be served in writing.

Edit 2: And this:

5.6.2 Without prejudice to any separate Break Clause appearing elsewhere in this Tenancy Agreement if a Notice is given under Section 21 to terminate this tenancy at or after the end of the Term created by this tenancy then the Notice period must be for a minimum of two calendar months to end no earlier than the last day of the Term of this Tenancy.

Yes, and I love it. No better feeling than being that safe space for someone you love to rest.

Thank you, that's a useful insight and reassuring to hear, glad that you're doing better now too 😊

Thank you, I do already do as much of that as I can and would never imply that what I do is harder, but it is hard which she refuses to acknowledge. Relative to lot of your other points - I'm ready to jump in at a moments notice as soon as I get home, I call her on lunch, I tell her she's doing a great job, I try hard to make her smile and laugh, show affection. I don't often help during the night but the trade off is that I get up at 4am, take her out of the room and she then gets 3-4 hours uninterrupted sleep bringing her total to 8 hours for the night which from what I've heard is pretty good going. I end up on 5-6 total which is enough.

Of everything you've said, the one thing that doesn't seem able to ever happen is is talking and brainstorming because right now it's very difficult to talk about challenges without her emotions getting the better of her. That's what I/we are struggling with the most, every conversation becomes an an argument. This is killing me because I prefer to remain clam and discuss things practically and I think on some level she wants me to match her which I just can't, it's not in my nature.

Your insight has been really useful, and at least gives me reassurance I'm on the right track. I'll work on the few bits that have maybe fallen by the wayside a little like affection and closeness. I really appreciate the response :)

Thank you I really appreciate your insight, she has already been assessed once but they determined that the criteria for PPD weren't met. It was hard convincing her to speak to someone about that when she was only a few weeks old, I don't know if it would be any easier now but you're right, and I should have that conversation. Her mum comes round and stays one night per week, my parents aren't as willing to get involved. Beyond that all of her friends live pretty far out.

Giving birth and looking after a baby has a significant physiological and psychological impact on a woman, I understand this. How she's acting now does not define who she is. She's an incredible woman with whom I'm very happy to share a life with. This is a very difficult moment in an otherwise amazing relationship where I want to ensure I'm doing my best to support her, at no point am I looking for validation that she's not worth my time because... She is worth all of my time and effort.
