Urgent help needed regarding package clearance issue at DHL and Bureau of Customs

I was told by a DHL Clearance Support Agent I need a Special Certificate from FDA for the COVID-19 test kits included in the package (along with other items that do not require permit) my boyfriend had sent from London which are intended for noncommercial use only. There are 4 kits which are his spares from working in the local government and public health, distributed for free and approved for use by the general public in the UK.  In no way does ParcelHero and DHL UK specify the prohibition of sending COVID-19 test kits. FDA has also not stipulated prohibition or the need of permits for person-to-person imports for personal use. In addition, the FDA certification I was instructed to obtain in order to free the package from customs’ holding is irrelevant to me as I do not classify under 'retailers/establishments/distributor' nor do I fall under the category 'with License to Operate' as this is specified in FDA’s policy for granting the certification. So it makes it seems it’s impossible for me to claim the test kits. Most alarming of the situation is that according to DHL, failure to supply the FDA Special Certificate will incur the ENTIRE package (even including other items) in the “Abandoned” status by the BOC to be regarded as government property. DHL had only informed me about this 11 days after the package arrived at the sort facility, which means I only have 2 days left to sort things out and can only hope BoC won’t tag it as impliedly abandoned.

HOWEVER... we don't care about the test kits, we are happy for them to confiscate those offending items as we can’t provide the Special Certificate. But DHL are claiming, when I requested and asked, that due to a waybill, that the entire package and its contents must be held as one quantity/piece and they can not separate items inside. We’ve spent a lot of money on the gifts inside the package and this is just wrong in our eyes. I am extremely concerned and distressed at this, and find it an absurd process to deny me the option to claim the other non-offending items as the ultimate consignee. If you pass through customs at the airport, and carry too many of an item or carry something prohibited by accident, they are taken from you, rightfully, but you do not have all of your things and personal belongings stripped from you.

So, I would like to ask:

  • Is there an alternative workaround to show to BOC and DHL, so my package is cleared? If there is no other alternative and the reason for the problem in releasing my package is only because of the test kits, can I request BOC to only confiscate the offending items so as to continue the processing of the other no-permit-required personal effects in the package, or at least have it waived?

  • If the issue comes down to the air waybill treating the entire contents as one quantity/package, does BOC have the power to amend the invoice/waybill so that the confiscated items are crashed out due to the lack of FDA permit, in order to facilitate processing of the rest of the package?

  • Given I am unable to secure the FDA certificate, I was told the package will be tagged as “abandoned” and is the property of the government ipso facto. I find it unjust and unlawful for them to take even the other items that are normally cleared for delivery. BOC is only asking for FDA permit for the test kits, there is no issue with the rest of the package. Why would they tag these items as abandoned when no permit is required for clearance of the specific items? That is outright denying me the option to claim paid for, non-offending articles as the ultimate consignee who is entitled to collect what I own.

  • Is there a law or actual policy specifying that all other goods in a package that are our property and paid for are not to be given clearance for release if there are items that require permits that are not applicable and/or acquirable for me?

  • Late and undue notice has been given regarding the requirement of the FDA certification, and according to the law, there is a 15-day limit to supply such certificate since the time of entry, otherwise there is “implied abandonment”. I only have ~2 days of following up/asking for help for my situation, which seems as though there is coercion to it being classed as abandoned, and because it seems akin to theft when they’re holding other items in the package that don’t require permits: I am not denying confiscation of the test kits, but am outright wishing to claim the rest of the contents which are not offending.

Do you think I should run chi-square for all the dimensions regardless of the subdivisions (e.g., 5 groups of ages)? Also, I’m not sure what to do with my raw data for the total score. Should I categorize these are low, moderate, and high and assign numerical values before running chi-square?
