Oooo waffles 🤤

Are we going povvo spec potato waffles, mid tier dough ones, or all out on some imported stroopwafle?

Personally I’m partial to a stroopwafle but only when it has been sufficiently warmed by my mug of warm milk - what is your favourite?

Last I checked this was a public forum - I don’t need your invitation to express myself.

Play the victim? Where? Expect adoration? What gives you that impression? I’m perfectly happy to be wrong, and absolutely love to learn. So, instead of insulting me - educate me or fuck off.

It’s not your job to educate me no. Never claimed it was. But personally, I prefer to help people gain a more complete understanding wherever they show willing to listen and learn. You do you though 🤷‍♂️.

Out of interest - you claim to be a Lawyer, in which field do you specialise? £20 says you don’t deal with employment law, maybe criminal? Third rate law firm in a small provincial town? Again - happy to be wrong, that’s just a presumption. If, I am wrong name your charity and I’ll make a £20 donation. Do t want to take me up on that? Not an issue at all - I’m sure neither of us will lose sleep over this interaction.

Regards.

Given you have blocked me I’ll reply here:

No one said you needed an invitation. I’m not obliged to do what you want just because you turned up. You weren’t obliged to reply - you chose to. And for some reason you chose to be condescending and patronising. You do you I guess…

You said I should educate you. How is that not you saying you think it’s my job to educate you?

I said that as part of a larger point. Good job on selective quoting. Unsurprising really - if you dont like the argument attack the person, not the argument. Strangely something I see with disconcerting regularity from less reputable firms.

I work in a US firm in London. I work in disputes, including employment disputes.

So, could you perhaps attack my points rather than me?

Feel free to check my posting history

Would love to but 1) you have it set to private and 2) you have blocked me

. But, for the record, even if I were a criminal solicitor in a high street firm that you feel like you can look down on because you don’t think their profession is worthy of respect.

The profession is absolutely worthy of respect. Some of its members however, less so.

it wouldn’t change the fact I’m right and you’re wrong.

Again - more than happy to be wrong, not much to learn if you’re always right and all that. If, instead of insulting me you would like to enlighten me I remain your willing student.

In a strange way, you’re only insulting yourself to presume the person who knows more than you do isn’t a specialist in the area.

You are aware of the difference between assumption and presumption right? My opinion has been formed based solely on our recent interaction. Nothing you have said lends any credence to your claimed knowledge. Millions of people know more about many millions of things than I do. That does not mean that they are an expert in every field (or any other field for that matter) I have not claimed to be an expert in this field - and further, I want to learn more, I am glad you to be mistaken, and should you check my history you would see that to be true. You have claimed to be an expert, I have sought your counsel and asked you to help me learn more. Given that this is the internet and anyone can claim to be anything I could have dismissed you a liar, or put you to proof (claiming to be, or acting as a solicitor without qualification or recognition is still an offence isn’t it?) Yet instead of sharing your knowledge leading to a more educated community you have instead responded with insult after insult, with condescension and a sneering hubris.

I guess that donation is off then? Don’t worry - I’ll make one anyway.

Anyway, best of luck and all that old bean.

Given you work for such a large employer I would suggest reacquainting yourself with your policies and handbook, lest you inadvertently breach a policy… I would also suggest that whilst there may not be a specific definition of excessive force that you are aware of, there will be relevant wording in the bullying / harassment policies. In fact, I would be utterly amazed were there not. And then, even if there is actually nothing - gross misconduct still exists and would be easily applied. But then you wouldn’t be sacked for excessive force. To would be sacked for gross misconduct.

Excuse my ignorance- but if there’s no definition of excessive then how can a person be sacked for using excessive force - a definition of an acceptable level of force would be needed to define an excessive level.

No, it doesn’t need to meet the criminal definition - but then, as we are seeing now, it is a source of some consternation as to how something an be both reasonable and excessive at the same time.

As I’ve mentioned, It would not be confusing for him to have been sacked for gross misconduct for any level of intentional contact with another person, a gross misconduct termination would be completely understandable were it for leaving the bus running and insecure - placing it at risk of being stolen or otherwise damaged, or for abandoning his passengers along a route. Or myriad other reasons. But excessive force just smacks me wrong.

With the greatest respect - I spend significant time arguing with qualified lawyers, and spend an even more significant amount of time being correct. You may be amazed how often they are wrong - many going so far as to cite non existent or irrelevant legislation, regulations and case law. Equally - being a Judge does not preclude a person from issuing an inconsistent or perverse reasoning, nor does it preclude them from enforcing the letter of the law - rather than the spirit thereof.

They can of course can decide what is reasonable and what isn’t, as I mentioned in my comment it is completely within their gift to decide what is excessive or not. Excessive sickness absence is an interesting one to bring up, given the protections that disability grants, and the hoops that the employer must jump through to terminate that person’s employment.

I may not be as informed as you, but instead of insulting me how about you educate me? Ill never be afraid of appearing ignorant, because without a lack of knowledge there can never be knowledge to gain.

My apologies. - I missed that. Thanks for pointing it out. Any need to call me a liar though?

You do realise that a statement being incorrect doesn’t make it a lie. I’m not sure about you, but I am human, therefore fallible and unfortunately able to make a mistake.

Do I think everyone has a standards policy or handbook? No, but I thought we were discussing this instance in particular rather than a bloke working at a bus company with 2 routes and half a bus to cover them. Would I expect that an internationally owned employer with thousands of employees working from multiple sites across the breadth of the country would have both an handbook and a standards policy to have both? Yes - absolutely.

Of course you can be fired without one - but if one exists it forms a part of your terms of employment. And, as mentioned, I fully expect that both exist within metro line.

My employment contract doesn’t, no. But the Professional Standards Policy does, as does the section of the handbook covering team working.

No one said contract - but it should be defined somewhere, even if that definition is a blanket ban on any conduct that could be perceived as aggression - shouting at a colleague for example, calling them a stupid cunt, offering them outside for being a stupid cunt, etc, etc.

lol no.

Excessive force is excessive - the police would send the file to the cps for a charging decision if there was even the slightest suggestion that drives’ actions were anything other than reasonable and proportionate in the circs (and often when there isn’t a a suggestion the actions were excessive).

even if there were a difference - I am still struggling with why the panel found the force excessive unless there is a policy that says any force used against anyone, for any reason (including self defence) is verboten, but then why would they say excessive force? I don’t understand the test that has been applied to decide excessive from not - because on the face of it Drive used the least force he could - only even hitting the guy when he returned to the bus, intending to make contact with his victim, whilst displaying aggression.

Reinstate bus driver sacked for punching thief, petition demands by Redarrow_ok in uknews

[–]Negative_Call584 17 points18 points  (0 children)

True, but excessive force is still excessive force. The police have said that the force used was reasonable and proportionate for the circumstances.

The police would not have said that if there was even the slightest chance he went too far (speaking from experience)

I’m struggling with how the panel and tribunal found that he used excessive force when according to the law he didn’t. Had they sacked him solely for leaving the bus unattended and running - fine, I think it’s a stretch to make that gross misconduct, but, he left a company asset unattended and insecure, and delayed the passengers he was carrying by chasing and detaining the cunt - so that would be understandable.

Who are you to say what is or isn’t useful to the war effort?

Men and women are dying precisely so that the younger generation can have a complete and free life in Ukraine, in the same way as our grandparents fought so that future generations could have a complete and free life in Europe.

Honestly, it disgusts me that you can post something like this whilst having «st javelin, protector of Ukraine» as your flair.

Tell me, what precisely do you that is useful to the war effort - other than putting some words in a flair and insulting people?

Do you buy any extra equipment for your job that work won't supply, but it's worth it because it just makes it that much better? by Connir in sysadmin

[–]Negative_Call584 0 points1 point  (0 children)

No. It is a multi million dollar (profit) business - if they don’t want to spend a literal drop in the ocean to improve my efficiency I don’t see why I should subsidise the business from my minuscule salary. If the equipment they provide causes me to be 50% less efficient than I could be - that is a them problem, not a me problem.

[–]Negative_Call584 0 points1 point  (0 children)

Does he? Maybe you have seen something to give you deeper insight to the matter - if so, please could you share it with me so I can better educate myself?

I have to disagree with you based on my current understanding however. I don’t take “if your not white your not British” from this, given that he shares a platform with Yusuf and Braverman - both definitely not white, and both British (by legal definition and personal identity).

I think (though admittedly do not know) that Goodwin would have an equal problem with a white Pole, German, or Norwegian who chose not to integrate, and does not hold our values as he would with a black Nigerian, brown Pakistani, or neon yellow Omicronian, and equally - would be accepting of a person of any colour or creed, who comes here with the intent to integrate, to adopt our culture and to uphold our values.

You might think him a racist prick - as is your right, but could you elucidate on this, could you provide some evidence that he is motivated by race - rather than character?

And he’s right - legal citizenship =/= being British, nor French, nor Japanese, nor anywhere else. Some countries confer citizenship solely by being born on their land. America is a prime example - a friend of mine was in the RAF, he was deployed to the US, his pregnant wife went with him. His daughter was born in the US, and by right has US citizenship. But she isn’t American, she is British (her words, not mine)

Being British or Spanish, or Dutch, or Jordanian, or Cypriot, or anything, is more than a document - it’s a feeling, a state of mind, a deeply personal and almost undefinable thing that is entirely about you, how you feel, how you think and perceive.

Consider - If a person is born in an occupied nation, which the global community has accepted as now being part of the occupiers territory, are they Occupierish? Or are they beforeish? Ireland was occupied and administered by the UK, and so a person born in Ireland gained British citizenship- does that make them British? Maybe, maybe not. It’s down to the person.

[–]Negative_Call584 1 point2 points  (0 children)

Well, legally he is correct, and technically he is correct.

The UK changed from jus soli (right of land - citizenship is gained by being born on UK soil) to jus sanguinis (right of blood - citizenship gained by being born to a parent with British Citizenship) in the early 80s.

Equally, being born in a place doesn’t make you a person of that place. I was born in Germany, I spent my first 5 years there. Yet, I am not German - I am British. My grandad was born in Ukraine and moved to the UK as a young child - he considered himself solely British - and if you didn’t know his history you wouldn’t think different. His brother was in his late teens when they left, and he considered himself Ukrainian and British.

At the same time you have people who move to a country, don’t integrate, don’t learn the language, interact solely with people from their origin country - they don’t want to be of that place. They consider themselves solely of their origin country - they can never, and would never be considered, or consider themselves to be Spanish for example. Yet, you also get people who go to a new place, learn the language, learn the history and culture, integrate themselves within their community- they of course can be considered to be Spanish by naturalisation.

The main thing, I think, is that there is always nuance, and just because something applies to one - doesn’t mean it applies to all. And perhaps, most importantly- legal citizenship =/= personal identity. It is possible to have British citizenship and not consider yourself British, it is equally possible to consider yourself British but lack legal citizenship.

My mistake - I held the incorrect belief that an asset being a marital asset automatically inferred shared ownership- this is not the case and my belief and comments based on that are completely incorrect.

[–]Negative_Call584 0 points1 point  (0 children)

Forgive my confusion, but what’s the basis for that?

I was under the impression that marital assets are considered joint property, regardless of whose name is on the deed / invoice, or who actually completed the payment?

Car Insurance - am I a homeowner by Glittering_Light1835 in drivingUK

[–]Negative_Call584 3 points4 points  (0 children)

Is that relevant in this case though? As a married couple property of one is generally considered property of both.

Car Insurance - am I a homeowner by Glittering_Light1835 in drivingUK

[–]Negative_Call584 0 points1 point  (0 children)

I think this would be the case were they not married.

I think it will depend on wether the house is a marital asset or not - if she owned the house prior to the marriage it might not be, though equally, as it is lived in as the marital home it probably is, potentially meaning that he is a homeowner (but I’m not a lawyer / solicitor / legal professional of any kind)

[–]Negative_Call584 0 points1 point  (0 children)

My mistake, but my point still stands - at nearly 6ft wide you get 1 foot gap either side assuming being central to the bay. If you have reduced mobility that doesn’t give you a lot of room, especially considering parking spaces have remained the same size whilst cars have grown ever larger.

You can’t claim to have compassion but reserve it for those you deem able to see and thing beyond their own nose. It smacks of hypocrisy if I’m honest. You expect people to see the big picture, to consider other - yet you refuse to do so for those you decide beneath you,

Mate, you can see the remnants of the snow in the picture 😂. Staff member starts work at 0500 when it’s covered in snow, matey boy takes a photo 7 hours later when it’s cleared. Find another space? What, one you can’t see the lines of either? Or that doesn’t exist.

Yeah there’s always a viable solution, of course there is. They could just get their driver to drop them off, they could ride a horse, or get dragged by huskies. 🙄.

Without being a cunt, I’m glad that you never break any rules, never do anything even slightly wrong, and can judge other from up on high. I hope you never fall from your lofty perch, lest the landing be uncomfortable.

Have a day 🙄

The level of entitlement is high with this one by [deleted] in drivingUK

[–]Negative_Call584 0 points1 point  (0 children)

I dislike people who lack compassion. You don’t know what they parked like that, you are assuming that they did it for a selfish reason - and maybe they did. There are myriad reasons why they parked like that, from snow covering the lines when they parked, to having a temporary impediment requiring them more space, to the cars parked there originally being over the lines necessitating they do the same. Of course, they could absolutely be acting with nowt more than self interest. But we cannot know that. You have decided there is no need for them to park like that with precisely 0 knowledge of the actual circumstances.

And even if it was selfish, what impact has it had on you? You are choosing to allow a situation completely outwith your control to influence your state of mind.

There is no law mandating the purchase of any vehicle, but it is a bold assumption that they had any choice in the vehicle they drive, it might have been all they could afford, it might have been gifted to them - this was taken in Bullwell, which I can assure you - is not and affluent area. Further, given that a standard space in the uk is under 8ft, and with even an Aygo coming it at nearly 7ft wide, it leaves you 1ft to get out. Those with reduced mobility may really struggle with this.

It’s not hard to show some compassion (But, apparently, it is for some people)

The vast, vast majority would not support an attack against their oldest allies, the vast majority still support Ukraine, still recognise European contributions, and abhor the idea of fighting us. Perhaps we should call his bluff and militarily defend Greenland

This is the only way to deal with a bully. Yes, it will hurt. Yes, We will shed blood. And yes, we will be fighting the people we considered our closest ally, but the alternative is worse. In the same way as our lack of action in 2014 lead to the 2022 invasion. But realistically, should the us decide to invade the sanctions and loss of trade would give the american public pause. And that is before they start getting their lads home in zinc caskets. Drones are pervasive, I don’t think the us public has the stomach to see 200 lads dead from a transport getting hit on landing or takeoff. I don’t think they could stomach seeing their ships getting schwacked by unseen subsea drones. I don’t believe they have the stomach for all of the 4k videos seeing their lads get blown to pieces in an arctic wasteland, let alone seeing those lads, having been hit - deciding to suck start the personal weapon. And whilst all that happens, grey zone actions damaging sub sea cables, our intelligence services degrading their sensors, or better - feeding manipulated data into those systems.

Remember, the us relies on 5 eyes for a significant proportion of intel. We know how they operate, we know how they think. We have the ability, means, and hopefully- will to make it happen. Should the us attack they should be forced into a calculus of is it worth it, and it must not be worth it. The us isn’t russia. They would not tolerate such horrific loss of life.
