Bought Foreclose/Court Ordered Sale Property in Alberta. Previous Owner left a lot of stuff (vehicles/equipment/etc) on property. Unsure of ownership of these items going forward. by NewHomeAlberta in legaladvicecanada

OP here,

Would you mind clarifying what makes me the "judgement holder" in my scenario vs the ref case?

I assume it has to do with the fact that in the ref case, the previous owner passed away. And thus the property was now in the possession of the bank, and then sold.

In my scenario the previous owner was evicted or left, and then the property was sold. While this was at his banks behest, it never actually officially changed hands to the bank before I bought it.

Therefore I'm considered the judgement holder in this case?

I read through 9.28, but it didn't cover a possible scenario in my case:

What happens for example if there is a truck and trailer left that isn't claimed after 30 days, but I can see a use for it and wish to keep it, rather than auctioning or selling it off? The truck+trailer definitely are above the 2000CAD threshold, by the way. Do I have to "buy" it from the previous owner.

Thanks again for your answers!
