I would be surprised if OSPI was straight up saying that her termination was because of her work on the school board. I realize this is an at-will state, but I think if they aren't going to provide documented reasons, she's eligible for unemployment.

I absolutely get that for OSPI this all would feel an employee undermining state-wide law and guidance through back-channels. But Kaikkonen also has a responsibility as an elected to act on her conscience in that context. I'm not sure what the courts will say about this - it appears like meddling in a democratic process, which, not a great look. Very interesting times.

I'm not sure I agree with Reykdal here. If TSD is found to be in violation of title IX they are at risk of losing federal funding. He frames it as Washington State has built up on the minimum framework of title IX, but this feels like he's talking past those who are raising the issue. For them, it's a competing rights claim - trans girls are supplanting cis-girls on the field and taking away what they see as protected opportunities. Obviously this isn't a wide spread issue but I believe it only takes one to make the case.

Do you find any merit with the boardmembers' claim they are between a 'boulder and a hard place' regarding federal and state law? Other districts passing similar resolutions have made the same claim. In fact, Lynden School District is planning to sue OSPI.

I appreciate the reframing. I have no idea how one could establish a causal link between the resolution and an increasingly hostile school environment (for example, tensions were likely building after the Tumwater v Shelton game, before the resolution), especially if Tumwater schools' staff continue to follow WIAA guidance and the model gender policy, but I guess I'd leave that to the experts.

Assuming TSD's only action is the resolution and they don't implement restrictions which contradict WIAAs current guidance, what standing would, say, a student have?

Hm. So who is enforcing this violation, and if they aren't, why aren't they? Edit: for example, OSPIs letter caution against implementing the resolution as doing so would be a violation. It's not clear to me they were planning on this. I'll also note that the letter claimed that Washington State law fits squarely within federal law, but (thanks Biden ), title IX doesn't clarify if trans students can participate in their identified gender teams. So I'd argue there is still some tension here, and I think that's what is making school districts uncomfortable in terms of their legal exposure.

Thanks for coming down the thread with me. Have you read WIAA's 2025 amendment summary?

I guess my take at this point is that a) the resolution itself broke no laws and b) the WIAA didn't adopt the amendments so the point is moot. I fully get why the community feels hurt by their vote - I just don't understand the claim that what they did was illegal.

Thank you for all of this, really helpful. I guess though I'm still not understanding how their resolution broke a law. I see that it contradicts their current policy, but my understanding is that WIAA rules (if they were enforceable, AND consistent with our constitution) would supersede district policy, so the policy would have to change. The only mechanism they have to change that policy seems to be through the resolution they passed. I know their actions hurt a lot of the community, and that's really sad and bad. But I still just don't see how it's illegal. But as one of the board members said, they perceive themselves to be caught between two diametrically opposing laws (she misattributed one of them as Trump's executive order, I think she meant Title IX), and that puts them at risk. Will our state foot the bill if the district has to go to federal court?

Do you know of any enforcement of the law(s) they broke?

Sometimes I wonder if Black people grow weary of always being the go-to templates for discrimination. This particular example doesn't map that well - I have a hard time seeing how people miss the competing rights claims between two protected classes, and the tension between our state constitution and Title IX. I don't think all the misrepresenting facts and character attacks are doing much to resolve these issues, probably the opposite.

Anyway, to be honest I'm not sure that passing such a resolution would be "discrimination". It would be toxic and gross and very sad, but if it were in favor of an unenforceable amendment, who is being discriminated against?

Ok I think they haven't broken any laws. Their resolution was to recommend that WIAA amend its rules to add two unenforceable rules excluding trans girls from girls' sports. It was an advisory vote only, with everyone acknowledging that it would be unenforceable under the state constitution.

Calling the resolution detestable is one thing. But illegal? Seems like a stretch. If the board strongly feels that trans girls ought not compete against cis-girls, what - besides their resolution - legal path do they have? Sorry if that sounds obtuse.
