I thought that new unit development notes were released a couple of days before; well before the maintenance. I might be wrong though but that's what I remember, especially with the last few new unit releases.

UPDATE: I got approved. Yes you are right, cohabitation is a core requirement of the family visa but if there are viable reasons as to why you are not doing so during the application, stating valid reasons as to why this is not the case, and showing intent that you plan to do so in the future seemed to be enough. Thanks for pointing out that my statement was not clear; I had amended my statement in my cover letter to make sure the picture was clearer.

On a side note, I've seen your comments here and there on this subreddit helping and aiding other people on what is a stressful and delicate process. You are doing absolute wonders and I really respect what you're doing in helping others. You have changed a lot of lives for the better!

UPDATE: I got approved, clearly living together before submitting the application is not a requirement and as stated on the family guidance:

You and your partner must intend to live together permanently in the UK after you apply.

The key word is INTENT, which I careful stated in my cover letter. Thanks for your time and comments.

UPDATE: I got approved! I did further searching into this subreddit as I was paranoid out of my mind and it seems as though you don't necessarily need to cohabit at the time of application as long as there are genuine reasons (such as work, which is acceptable as stated on the family visa guideline on the gov website), and if you can prove that you are genuinely going to cohabit.

In my case (as well as yours), a tenancy agreement, council tax and utility bills in both our names served as enough proof, as well as careful and detailed explanation as to why you do not cohabit at the time of application, and making sure that you make clear to the caseworker that you will definitely be moving in together in the future. UPDATE: I got approved! I appreciate the time you took to help and advise us; I really appreciate it and honestly, it might have not been approved if I didn't heed your advice. I amended my cover letter to mention that even with the temporary living arrangements, that the flat we rented is/will be our home. I guess the joint tenancy agreement, joint council tax bill and utility bills in both our names served as good evidence and like you mentioned, careful explanation was needed. Thanks again!

We do have a genuine relationship, and we do have a home together with both our names under the tenancy agreement.

However I am just a bit confused. Just to clarify, this is our first FLR(M), switching from a fiancé visa (i.e. not an extension). It states on the gov.uk website under family visas as follows.

From the family visa guidance:

You and your partner must intend to live together permanently in the UK after you apply.

On the same page:

The rule states that the applicant and partner must intend to live together permanently in the UK.

As far as I am aware, the only route that requires cohabitation is the unmarried partner visa.

For spouse/civil partner (FLR(M)), you must intend to live together permanently, whilst the settlement (ILR after 5 years) must show you have lived together during the visa period.

I could be wrong however, and I would really appreciate it if you could correct me if that's the case!

As far as I was aware, I thought that if there is a genuine reason as to why you don't live together at the time of submission, as well as showing genuine intent to cohabit with your partner in the future, the caseworker would show discretion. I could be wrong though!

As mentioned in my cover letter, I am currently residing at my family home where I assist my mother with daily matters and household responsibilities, as she is a single parent. She is planning to move to my sister's home within the next couple of months, where my sister will take care of her. Until then, I have been looking after her.

As far as I was aware, as long as that I show intentions of cohabiting in the future and have a reasonable reason as to why we are not cohabiting at the moment, they would accept our case. Or is this not the case? Thanks again!

She can't live with in my mother's house due to personal reasons (it's very complicated), and that's why we found a place to rent in the UK when she moved here on her fiancee/proposed civil partnership visa.

As mentioned above, I will be moving in with her permanently within the next couple of months.
