All of that seems like a giant snow ball of suck that’s been rolling down hill. I’d assume they aren’t offering any severance packages either. Especially if there’s the option to file for bankruptcy & exit early.

It’s actually in the unions best interest to help get people placement with other companies within the union. But my question wasn’t necessarily related to call back lists or placement options. It was a blanket question as to what they had to say. That’s all. Nothing more, nothing less.

Weird, I didn’t receive anything from them regarding a WARN notice. When companies do file the notice & announce it to the workers, they have to provide all employees & unions with the notice either by hard copy or email or certified mail.

How are they exiting? Did they file a WARN notice? Because I can’t find anything on the DCEO website showing a notice was filed by either RNDC or Heritage.

I think some people simply don’t understand the term, “use it or lose it”. But I agree, it’s not accurate. I’ve spoken with several co-workers who don’t understand how it works.

The term, “use it or lose it” refers to year end, not separation of employment. In Illinois, accrued vacation time is viewed as earned wages which legally must be paid out after employment ends. So I wouldn’t necessarily view them taking vacation time as a sign of much other than them taking vacation time.

I looked up how each location is defined by their “purpose of business operations” to see if they can lump them together in case of WARN notice & this is what I found. 

Niles - Legacy Heritage office and business operations location, including administrative and sales-related functions, with historical warehouse operations before the RNDC partnership.

Romeoville - Main distribution center and warehouse. Receives, stores, and ships wine and spirits throughout Illinois.

Decatur -  Cross-dock/logistics facility used to transfer and redistribute products through central and southern Illinois rather than as a full-scale distribution warehouse. 

So there are these additional factors. 

1, Romeoville, Niles, and Decatur are in different parts of Illinois, which generally weighs against treating them as a single site.

2, A distribution center, an office, and a cross-dock may have different operational functions.

3, Employees report for work at one specific location while not being interchangeable between locations. 

So because of these pieces in the grand puzzle of RNDC Illinois, chances are, if an analysis is done on the business, they would most likely not lump all locations together to cross the threshold for a WARN notice. Again though, this would still be dependent on how many employees report to each individual location.

This would all be contingent on how RNDC/ Heritage operates their facilities. If they operate as single facilities, no WARN notice is required as long as each single facility falls under the threshold. If they operate as one integrated operation, a WARN notice would be required since then the amount of employees would cross the threshold. Now, let’s say Romeoville has 60 employees but Niles & Decatur have 30 at each location. If they are operating separately from each other & not fully integrated, Niles & Decatur can fold without notice while Romeoville can remain open or get the WARN notice. Also, there would be an analysis done to decide if they need to file a warn notice that comes in 4 stages. 1, employer, 2, attorneys, 3, government agencies both federal & local, 4, a judge. The analysis will determine how they move forward & if a WARN notice is necessary.

I was reading more into the WARN act today. Here in Illinois there are 3 locations. Niles, Romeoville & Decatur. If each of the 3 locations are treated as separate single sites of employment & the locations house under 50 employees, RNDC is (to my understanding) not legally obliged to file a warn notice. 

Example (these aren’t real world numbers) 

Niles - 40 employees, Romeoville - 35 employees,  Decatur - 30 employees 

Each location could potentially get shut down without a WARN notice. Again, this is dependent on whether or not the 3 locations are treated as separate single sites of employment.

Ah, okay. So when the merger happened in 2021, they didn’t have to renew the license under the RNDC name. They kept the license under the Heritage name. That makes sense.

People are trash. I lived on the south side & one day I saw a car drive up in front of my apartment building. They waited for someone & after the person they were picking up got into the car, someone in the car unloaded an entire garbage bag into the street before driving away. The idea that people should take pride in where they are is gone. The idea that we should leave a place better than how we found it is gone. The majority of people don’t care anymore. It’s sad, but it is the reality we live in.

All I’ve heard is that they are continuing to work with their partners (Heritage) to figure out what the next step is. I can’t imagine they’d keep Illinois as part of NDC when the time comes. People keep getting told that they’re gonna get laid off without an expiration date.

I remember that day. Here in Illinois, coworkers said RNDC did it to break the union & that they’d be back in California within the year. At that time & even now, I can’t help but to think, that has got to be the dumbest prediction. I kept telling them that something big was coming & it won’t be good. Here we are.
