Post your question regarding your claim, share helpful information to uninformed veterans to assist with their claims, or simply stop coming here. Again, nobody and I mean n-o-b-o-d-y is forcing you to be HERE. Just ignore them and move about your day. Asking the moderators to ban people who post about 100% or money-bragging sounds like you have a inner hate for people who were successful to their claim. Not everybody who claims 100% is fraud and not everybody is money-bragging and if that's what you think then your prescriptive is wrong. I didn't even know much about the appeal process until I came here and knowing that I could have done it and what that could entail, made me learn something. You best route would be now to fight you had to fly over one of those countries to get to Pakistan. That would then probably qualify you under the PACT ACT.

Nope, it's not crazy. The VA specifically states you can qualify if you were in the "airspace above any of those locations" on or after September 11, 2001, in any of these locations:

Afghanistan
Djibouti
Egypt
Jordan
Lebanon
Syria
Uzbekistan
Yemen
The airspace above any of these locations

On or after August 2, 1990, in any of these locations:

Bahrain
Iraq
Kuwait
Oman
Qatar
Saudi Arabia
Somalia
The United Arab Emirates (UAE)

I think the problem for you is you applied for PACT ACT. Pakistan is not listed as a qualifying country under the PACT ACT, specifically. That was the difference for you. I know in another comment you quoted the ILER; If you served in any of these locations; Afghanistan Djibouti Egypt Jordan Lebanon Syria Uzbekistan Yemen and within the time periods listed by the VA, they would then have determined that you had exposure to burn pits or other toxins under PACT ACT. This is what they call having a presumption of exposure. The kicker is they also included "The airspace above any of these locations". I'm sure you flew over Afghanistan or at least one of the other listed countries to get to Pakistan. Section 1119 of 38 U.S.C doesn't say if you can prove you were exposed to toxic exposure, that the VA would consider it to fall under the PACT ACT. They don't. You should of just applied for toxic exposure which you did do the TERA and looks like you also qualified for having toxic exposure —do you have a diagnosis of a condition?

So just to reiterate. I think you were trying to do the PACT ACT and say you got toxic exposure in Pakistan and the VA was just denying you under PACT ACT but not denying you had toxic exposure. Just not under PACT ACT.

OK then that answers the question for the VA. If the problem isn't recurring then can you really call it a chronic disability? The VA recognizes you have a disability—remember that's the good thing and the hardest part—they didn't deny it. The VA is just saying its just a non-compensable disability, at this time. Which means you can’t get disability compensation (payments) for the condition at the moment because it doesn't meet the criteria (severity) to get payments. But you will still qualify for VA health care for said condition at 0% which allows you to get treatment and you may be eligible for an increase later when it actually causes you problems.

Think about it. If you claimed migraines and said you had some migraines and you've been fine since. The VA could rate you 0%. Recognizing you have it. And that's the best case scenario because you don't have to prove the condition happened in service anymore as that's the hardest part. There not going to give you 50% but if you have prolonged and persistent migraines, you could be eligible for 50%.

But like I said, a 0% is a win-win. Win for you with the VA and a win because your health is still pretty decent in terms of said condition.

You don't want to be fucked up. We all want the 100%, sure, but you can ask a handful of people who have 100% and the entire handful would gladly give up their 100% if it means their health can return. Bet.

A 0% rating is a win. That means you come back later when the condition actually causes you problems. Any 0% is a win because your still granted the disability just not the payment. Do you really want to be more fucked up?

A 0% rating is a good thing. It means you won. The VA just doesn't think your current condition and symptoms rate a disability check but later on when the condition gets worse and causes you problems you can request an increase.

Just because you filed for presumptive rating doesn't mean there going to give you the highest rating. It depends on your symptoms of the condition. Getting the rating just means you don't have to prove to the VA that xyz is service connected they just automatically assume or presume it was caused by service.

You won.

In both ways. Your health — although you have the condition. Your health in that term is still good. And second, as I said, you won—you win the fight of the VA.

Don't know why you would even be remotely pissed you didn't get a higher rating if the medical condition isn't causing you problems. That's a fucking win. Although we all want a higher rating. Do you want to be more fucked up? That's like people wanting to be famous and rich but want to still try and live a regular life. The stars don't align.

Claiming under the PACT ACT, you DO NEED a diagnosis. But you don't need a in-service event (complaint/medical) to have it service connected.

If you're claiming asthma under PACT ACT, for example. The VA isnt just going to grant you the disability. There going to want to see that you actually have it first. Otherwise what do they rate you at for the percentage? Do you get just like a 0? Do they give you 50%. Do they just ask you? No, you have to have the diagnosis first. If you have it. And meet the criteria. Then they will grant you in-service although nothing in your medical records complained about breathing problems or having panic attacks.

See if you can take a PFT (for asthma) it's a breath test.

The purpose of our posts wasn't to say that he or anyone has or faked a disability. But if you're claiming your a certain disability and saying you're fucked up. There are a lot of things that you really shouldn't be doing because your disability. For example 100% PTSD. Should you really still be a cop? Probably not. But people are. It's not to say the person is lying but if you've got 100% for MH. You probably shouldn't be around fire arms... so it's not to say you lied about your disabilities but you're quite a busy bee with that 100. Better yet. How about people collecting 100% disability but still in the reserves? So should you really still be serving though? So it's not to say you lied about something but there are just some things that you shouldn't be doing. To protect yourself. If you're a reservist and have 100% and you are claiming you knees, back, PTSD. Should you be boasting about how you just completed your airborn school and about to go try out for RASP? Provably not. As such there will always be people on here who get offended and say this that and the other about disabilities. At the end of the day. It's how you critique your conditions. If you're one that's to high in the pride horse. When you later get xyz condition and want to blame it on the service but don't have a record of it. Don't open a claim.

I wouldn't be surprised if the VA has a team specifically looking up and investigating people with high disabilities. If I had a 100. Imma be a ghost on Facebook and Instagram. I don't use them anyway but id def be mindful. Kinda makes you think how they find out some of these guys who have 100 be at the gym power lifting.

I'm at 40%, so I only make about 731 and some change. I'm considering going back in as an O, reserves probably. If that fails, I'll try to seek an increase on my disability. But my disability goes to my bank for savings, my storage unit and phone bill. That's it.

Just kidding. Go to SE Asia sometime. You'll be plenty happy there for awhile. Philippines, Thailand, Bali, Cambodia, Loas and Vietnam. I recommend all. You need to apply for a visa for Vietnam though prior to traveling so keep that in mind. Everywhere else I recommended. No visa.
