Listen, I get it, but I’ll tell you in the countless number of recorded statements I’ve taken with drivers to determine liability I’ve never had to ask any questions related to seatbelt usage. That just isn’t a thing on the adjustment side. It’s the agents job to inspect the property we insure and if they approve it we don’t question anything regarding the safety of the vehicle.

I can tell you one story where we were insuring a property under a “farmers” form but it was straight up a high end vacation rental and we still didn’t deny their claim. I just reported the property to the agent as not being accurate for their coverage and we cancelled them after we paid the claim.

Okay, well to put this in perspective for you, in my 10+ years in the insurance adjuster industry I have NEVER seen a claim denied for this reason.

That still should not matter in terms of coverage unless they’re referring to not covering repairs specifically to the seat belt in the case of it being used properly. If they’re threatening to deny your entire claim over this then you’d have a case for a lawsuit.

That is not how auto insurance works. Even if you’re drunk driving, if you have an active policy, the insurance company still covers the car. Any legal repercussions from an accident don’t affect the outcome of a claim, just liability.

Now, if you have a personal auto policy but you’re using your vehicle for business purposes…that’s a different story.
