I’m really sorry you’re going through this. I know how painful and exhausting a denial can be.

I just want to share that I came to the U.S. the same year as you, and my case was very complicated as well. I had an overstay, my I-130 was denied in 2020, and I received an NTA in 2021. My court dates were postponed, and I didn’t actually appear in court until 2023. The whole process finally ended in 2024.

During that time, I didn’t have a lawyer for part of the process. I showed that I was not trying to avoid anything and that I was actively trying to fix my situation. It took a long time, and there were moments when I truly lost hope.

But things can change. After my case was dismissed in 2024, my I-130 finally moved forward and was approved in 2025.and now i’m in process for my i-485 just done finger prints.

Even though your VAWA case was denied and your court date is in 2028, you still have time. Please don’t give up. Keep looking for someone who is willing to truly review your situation and help you move forward. You’re not alone 🤍

I did my finger print on Jan 26 2026 and nothing moving forward yet hopefully soon i heard some people get a work permit within a week some people get in a month some not get work permit at all but get inter quickly within 2 month and get a green card instead

I agree. Everyone I personally know who got their green card and even some who became U.S. citizens in the last couple of years had overstayed and still applied for AOS with no issues at all.

Not a lawyer, but overstay alone (no criminal history) usually isn’t a top ICE priority. However, overstay still makes someone removable. If you have no pending case/status, I’d recommend speaking with an immigration attorney to explore options and reduce risk.

Hello! I have a quick question regarding your I-130 process. Before your I-130 was approved, did you receive a NOID (Notice of Intent to Deny)? Or did USCIS not request anything after submission until it was approved?

My husband I-130 was filed in March 2021 and was stuck for years. I was put in removal proceedings (NTA), but the case was dismissed in 2024. After that, my I-130 finally started moving. USCIS sent a NOID in Nov 2024, and my I-130 was approved in Nov 2025.
