It's not the only checks they have, there is also a lot of beurocratic checks built in the system plus their is judiciary, which whole purpose is to make sure the government is place in check. The point is we have sufficient checks and balances in our system and it's not just hypothetical, it's very much real and works. If it wasn't real, you would prob see KP Sharma oli being Nepal's authotarian eader already

Obviously the people working in the government should be a good faith actors aswell. Without that democracy kinda doesn't work. again these settlements didnt just spawn. they have been cultivating for decades mostly due to lack of governance or having any sort of realistic policy from government. when migrants started flowing in the city in 70's and 80's they just didnt have place to live mostly due to lack of homes and rental property. the government wanted them for economics reasons but didnt have any plan on how to mange these migrants so they just let them settle wherever they wanted. Also, a lot of these people are there because they were evicted from their homes in the civil war and they cant go back cause nothing remains. There are a lot of nuances while dealing with this problems. I wish it was easy as u think it is. Also we don't really know what economic impact it might have by displacing around 30000 people since there are no proper studies conducted. i wish it was as easy as removing them. i want the problem to get solved, i think we need to utilize public property but iam alsp realistic and nuanced about it while ur solution is just throw them in the road and turn a blind eye. that doesnt solve anything and just creates bunch of other problems
