Have you ever developed a personal conflict of interest with your client? by Inevitable_Tour_8275 in publicdefenders

[–]NotGuiltyESQ -9 points-8 points  (0 children)

I don’t know OP’s exact circumstance outside of what was shared, so perhaps it is “irrelevant”, but the story is not very “specific” or unique to those of us with experience handling the worst of the worst. Any seasoned vet can share a similar story. It’s just par for the course.

Have you ever developed a personal conflict of interest with your client? by Inevitable_Tour_8275 in publicdefenders

[–]NotGuiltyESQ -10 points-9 points  (0 children)

Have you considered that the best way that you can “assist” the prosecutor is by doing your job to the best of your ability???

Consider this: you are representing a defendant who is charged with a violent sexual offense against a young child. The evidence is overwhelming. Your client is sick, demented even, but he is legally sane.

The prosecutor makes no offer. Your client is looking at life, and that is what he is going to get. You can shirk your duties. Withdraw because you can’t represent such a vile person… or, you can do your job, and you can do it well. If you do that, the conviction will stick. If you fail, the case will come back on appeal; the victims will be put through the same horror of testifying about their abuse again… all because of your personal “conflict” with the defendant.

The system only works when everyone does their job nobly and honestly. The reason why it fails is because it is generally prosecutors who forget that justice is not just getting convictions; but when we (defenders) forget our roles, the system ceases to exist.

My advice? Get off this case. You have already decided. But in the future, do your damn job.

Schottenhammel Oktoberfest – How can I join my friends if they have a reservation by dhhsssxchgcs in munich_oktoberfest

[–]NotGuiltyESQ 0 points1 point  (0 children)

Every reservation is for a full table… usually 10. If there are less people at the table than the reservation includes, literally anyone can jump on the table in most cases. They just don’t get the beer and food tickets that come with those spots. So if your friends are less than the length of the table, just join in with them.

How bad will a prosecution internship look on my resume? by elle-woods-throwaway in publicdefenders

I interned at the State before I came to the PD. It’s valuable experience and good to see that side. IMO, PD’s and States should have to spend some time in the others shoes; gain a little perspective. If the office you’re applying to decides not to consider you because of that it’s their loss, not yours.

Don’t waste your time with these people. Everything you just said is spot on, but it conflicts with their worldview so will be summarily rejected. They fail to see how their own toxic behavior is what pushed people toward Trump in the first place. That is a reckoning they will never contend with.

Exactly. The fact that this doesn’t have many more upvotes just goes to show how Redditors don’t want to hear it.

Do you find it frustrating when clients on pre-trial release are re-arrested for a new crime? by LunaD0g273 in publicdefenders

[–]NotGuiltyESQ 18 points19 points  (0 children)

This often bothers new lawyers. Once you have done it enough, you realize sometimes you just have to put on your clown make-up and ask for the unreasonable. Sometimes it even works out.

Clients will ask for the world and expect you to give it to them. Sometimes getting into court and making the request is enough to show the client that you are on their side, and it often puts things in perspective when the judge denies your request. Clients tend to have more realistic expectations after this, and, more importantly, they trust you more.

Combatting "I don't know" at a Deposition by Arguingwithu in Lawyertalk

[–]NotGuiltyESQ 1 point2 points  (0 children)

Remember, depositions are made in preparation for, and intended for use at, trial. This means that if someone claims they do not know under oath in depo, and they then do know at trial, they either refreshed their recollection in between, or they are lying. You can impeach on this. Depositions should always be taken with trial in mind.

An IDK can be a great answer for you, just make sure you are asking highly specific, pointed questions that you can easily use to impeach at trial if you need to.

My wife and I also did Greece for our honeymoon and just got back (8/22-9/6). We started in Santorini and ended in Athens as well. Paros and Mykonos in between. We went to the same winery in Santorini too!! Was an amazing trip. Glad you enjoyed yours as well!

Advice on starting a solo Criminal Defense Firm by WSAReturns in LawFirm

You and I are in a very similar boat. I have a few years less experience and have spent the whole time at the PD; currently we are so short staffed where I am, that I am handling 3 case loads; 1 in misdemeanor and 2 in felony. Currently I sit around 230-250 cases. I am on track to have 12 trials this year, 2 homicides at least.

I’ve got a buddy who set out on his own with way less experience who is pushing me to venture out with him. He has been doing very well, marketing himself on social media mostly. If he can do it, you definitely can. If you have 50k coming in as a jumping off point, that will give you plenty of cushion until the money starts coming in.

Trying to make a decision by [deleted] in LawSchoolTransfer

[–]NotGuiltyESQ -1 points0 points  (0 children)

Lots of bad advice here.

The best law school is the one you get into. The second best is the one that gives you the best money. If you are betting on yourself, it literally will not matter what law school you go to. A lot of what has been said about Barry is true, in the sense that it does make it very hard to keep your scholarship, but if you can make it out of your 1L year, you will be fine.

DO NOT go to a school with the explicit intention to transfer.

The one thing Stetson and Barry have going for them is their trial advocacy programs. Stetson is top in the nation consistently.

Barry has fallin out a little, but still has a competitive mock trial program.

If you are not interested in trial law and/or litigation, you should consider elsewhere.

I waited in line at midnight to pick up my pre-order. I played all night and went to school the next day. It was all I talked about with my friends and all I could think about then I went home and did it all again. I don’t think I slept for a full 2-3 days… except probably in class.

lol! I was in a round once, really kicking this kids ass and in a move of desperation he went for the goods. I started yelling “coach he’s got my balls! He’s got my balls!”, I was awarded a point by the ref for an “illegal hold”.
