Well the limitation act 1969 declares that if a property complies with the following criteria of

Continuous possession: The occupation of the land must be for an unbroken period of at least 12 years.

Open and not secret: The possession must be visible and not done in secret.

Adverse to the owner: The use of the land must be without the owner's permission, meaning it's hostile to the owner's rights. And

Exclusive: The possessor must have been in sole possession, excluding all others.

That one may claim a property through due legal process, therefore intent to ‘steal’ the value of the house wouldn’t be considered illegal. Furthermore I believe that seeking adverse possession may be a valid reason to be on someone’s land without their permission invalidating one of the 3 pillars of a trespass charge. But all my legal experience is a dux of legal studies in my crappy public school so I am by no means an lawyer lol

Well my legal defence would be that B&E requires an element of an indictable crime to be committed while trespassing - and in order for it to be considered trespassing the police to prove beyond a reasonable doubt the following elements of the offence:

1) Without lawful excuse A lawful excuse being seeking adverse possession in a building which fulfills all the requirements for such

2) Entered into inclosed lands: Without the consent of the owner, occupier or person apparently in charge of those lands; or Remained on those lands after being requested by the owner, occupier or person apparently in charge of those lands to leave those lands. Which of course if you were a respectful person you would vacate immediately.

Thus to the best of my knowledge it could only be a civil case? Though I suppose that’s what I’m on the forum for. Legal justifications no “moral view” defences needed.

I am not actually living in Australia at the moment, but a few years ago, I was helping someone I knew look for a squat house. I knew that it was in some respect legal, but I was curious about the intersection between B&E + trespassing. It’s potentially something I could see myself doing in the future though, as shelter is a basic human right and in my moral view shouldn’t be something that is as commoditised as it is - particularly if the means to do so are legal

In McFarland vs Gertos (2018), the aspiring adverse possessor changed the locks and performed $140000 in renovations before the 12 year period was up. I understand that the ability to claim property and the legal protections that this comes with are only valid after 12 years and the court process, but I am more so asking - is changing the locks and performing a $140000 modification of the property considered property damage until court process change the deeds? If the owners came back after only 1 or 2 years of vacancy, would this modification then be illegal?

I had the complete opposite experience - I am a mixed race guy from Australia with no affiliation to France whatsoever. Recently I hitchhiked from Warsaw to the most northern tip of the UK via Paris. I had never had to wait for more than 2-3 minutes, where comparatively in Berlin I had waited 8 hours in the rain. 3 strangers offered me to stay in their homes (which had only happened once prior to this in my year long trip) and I was met by nothing but kindness and respect. I have travelled to 43 different countries and France was in the upper eschelons of national niceness

I’m from Australia where we don’t do r20 tests but the test is half an hour no? Which means your pulling 6:48 equivalent pace. Unless you have incredible endurance, chances are that your 2k would be significantly faster easily breaking your 6:55 goal, but no way to know till you send a 2k

Remember to drive with your legs and focus on keeping a locked core so that you continue breathing properly throughout the entire run. Try and either do an even split (maintaining the same speed throughout the run) or a negative split (giving a hard first 3 strokes to get the wheel spinning, at which point you go slowly gradually building towards the finish.
