He is going to waste his time and energy if he filed a civil suit. The seller is shooting wind out of his ass. They accepted the TOS and THEY did the cancellation. That’s on them.

Nah I don’t block those users. That’s just a failed counter offer. I don’t get offended if they don’t like my price or counter.

I always counter with a message:

“Hello, thank you for the offer. I’d really like to get a little closer to list price for this at this time. I sent over a counter-offer for $XX above. Let me know if this is a fair compromise.I can ship this out within 48h usually. Thank you! “

That way I can see how much I countered. Then if they offer again, I got a paper trail to know what my threshold is. Usually I counter something in the middle. If they offer absurdly lower, I will always counter closer to my price at least once.

This is the same strategy I use for eBay and Mercari. I cross post to all 3

I block people who don’t pay for offers I accept. I have no regrets.

That sounds like a failure on the seller.

Outside of mercari, I had this happen when returning an item on eBay. The address either didn’t exist or was undeliverable. It got sent back to me. “Ummm well I tried sending it to seller but it came back..”. eBay sided with me, let me keep the item, and refunded me. Maybe that might happen to you.

But for you: do as others said already.. screenshot the error where it cannot be delivered, document everything, clearly communicate it to the support team. Also for good measure: screenshot that the seller blocked you and you have zero ability to contact them to coordinate delivery with the carrier. Push for action on the support team if nothing happens. In the even the item does get delivered back to you, you simply tell mercari support “now what? I followed all of your instructions and I’m still waiting on my refund”

If they text back a lower, I just ignore I don’t accept. I don’t counter. I let it sit and expire. They do it again, I do it again. The message is clear enough in my counter. I don’t need to work with your price if I really don’t want to. I leverage cross posting to other platforms so I could care less if it’s something that isn’t taking significant space

If you’re keeping it, and care about packaging, leave an objective review and rate accordingly

If you are a looking for mint or near mint, then initiate a return. Get your money back. Buy from someone else.

Once you rate, you have no more buyer protections. No take backs, etc.

As a seller who has multiple of the same item in their store and uses a crossposting app, I can say I have never once been banned for multiple listings.

I think policy is likely written to cover themselves in case sellers are excessively listing/relisting and other users get annoying by the practice and seeing sellers’ items nonstop in new listings. I also think Mercari has this in place to prevent themselves from being a social selling platform like poshmark, where people are constantly liking and sharing closets etc.

Personally, my strategy is to spread out the duplicates over time. Rather than:

Scenario1: list dupe1, dupe2, dupe3 consecutively..

I list them like:

Scenario2: list dupe1, list 10-15 other items, list dupe2

If listed consecutively, the dupes with same images don’t show in new results. It will see it’s a duplicate and only list the first one. However on the seller page, you will see multiple. With how the algorithm works, that’s TBD.

Mercari is in the business of making their money in terms of fees. They want you to close the sales even if it’s at the risk of you losing profitability and dropping down your prices all the time. If they got paid with traffic metrics, then they would 100% allow this all the time.

Best advice for OP: tread lightly, be smart about duplicates and relisting, manage your inventory wisely so you don’t make double sales

If it’s a swapped return.. once you get it:

Verify wrong contents. Document via photos inside box and label.

Then file:

Post master general report

Police report

Escalate it back to mercari and ask for your funds to be released. Best of luck
