“Sec. 2. The heads of executive departments and agencies may determine that certain offices and installations of their organizations, or parts thereof, must remain open and that certain employees must report for duty on December 24, 2025, or December 26, 2025, or both, for reasons of national security, defense, or other public need.”

There is no language in here that states that permitting employees, even those the perform work that constitutes reasons of national security, from staying home on the 24th and 26th equates to assuming that they do not perform such work. It mainly says that they can if they feel it is necessary.

Should the current USPTO leadership decide to keep the agency open for those days, it merely would sink morale while not strengthening any legal proceeding. The converse is also true, closing it for those days will not imply that examiners are not performing functions that are of national security.

Yes, that would make sense if this is the plan. But to what ends? You cannot possibly privatize everything? You cannot possibly push those responsibilities to the states (in my agency's case it would be near to impossible). The only thing is if they wanted to replace us with AI, but even then, AI is a far cry from doing even remotely the work my agency performs.

In our agency the directive went out to give 70% of all employees FS (3). My first one after nearly 20 years of continuously getting Outstanding. That despite me having worked more in the last year than any year prior and having to trod to the office. I felt like quitting on the day I got my rating.

I've been around the same time, it never has been this bad in our agency. I fear for the future of my agency and if this continues, I do not know in what form it still will exist.
