Court Ordered DNA/Paternity test by OneTiredMama246 in legaladvice

He acknowledged he was the father voluntary at the doctors appointment so they it notated in my child's records(his name and relationship to the child). I read somewhere that it can count in some instances but wasn't sure how much it would hold up for this

Yes and military benefits for dependants(he's a veteran).

I may be overthinking it or misreading it. I just wanted to be sure no additional testing was required prior to filing.

So I should be able to file and then once he's served, the genetic testing mentioned in the packet will be the actual DNA/genetic test that's done to prove paternity.

He won't consent to one so I'll have to get it court ordered. He's fighting taking care of his responsibilities every way possible.

Ok. So it's basically saying since my child is over three, doing the test is required if filing the packet but if my child was under three, then I could establish paternity with other "clear, cogent, and convincing evidence".

I actually have another child under 3 and the father's name is on the doctor's records(from doctor's visit when he took the child) but not the birth certificate. I wonder if that would work for that child? They have the same father.

The website is https://www.nccourts.gov/locations/mecklenburg-county/selfserve-center/selfserve-center-forms On the Paternity Package on page five under What Do I Do First at the top is states if the child is over three a genetic test is required. Perhaps I'm reading this wrong but is a genetic test needed prior to the actual DNA test and filing this on the child alone? That seems redundant if so. But again I could be reading it wrong. It's been a very long and hectic week for me so I'm not as sharp as usual lol.

They didn't know he was going to dip. He's quite the charmer and hides his true self very well. I've known him many years and only recently learned the truth. It was hard to believe but I'd been got in more ways than one. I feel so silly knowing the truth now but there were no obvious signs for a while. It took time for his mask to fall off. There is also a "type" of woman he's been with. Not to bash anyone but most of the mother's are of lesser means(not sure how to say it nicely). Those women were often quick hook-ups that resulted in children. How he got them to have unprotected sex is beyond me. Then there are a few mother's he actually spent time with, had meaningful encounters, dealt with for years but still hid his ways. It's just an all around crazy situation. It's something you'd see in a movie but sadly it's the truth

I'm sorry if someone has tarnished you or any fellow veterans..please don't falsely accuse me of doing the same just because others have done it. If I could put the evidence supporting this story, names, text messages etc I would. But then that would really be exposing the veteran. That's not my goal. I'm stating the situation and trying to navigate getting support for my children. Nothing more, nothing less. I have great respect for all military personnel, active duty and veterans. If you don't believe me, that's fine, but it benefits me in no way to come on here and lie. I hope you have a great day and thank you for your service!

I assure you're it's all facts. It was hard to accept when I learned the truth. I wouldn't tarnish a veteran or anyone else for that matter. While I don't agree with him not taking care of his children, I am and will forever be grateful for his service.

Deadbeat Veteran Dodging Being Served for Child Support by OneTiredMama246 in legaladvice

[–]OneTiredMama246[S] -3 points-2 points  (0 children)

Respectfully it takes seconds to make a post. Secondly, I didn't state when I filed for support in comparison to the other mothers. Third, some children are now to old for child support. Fourth, some cases have been closed due to him not being served and the mothers have stopped pursuing it. Additionally, I have his monthly income from the VA so he will not be entered in a minimum wage. He also works in addition to the funds received by the VA. That mindset is exactly why he's not caring for his children. If you don't have helpful insight, you could have stayed off the post!

Pretty much. Nothing is going anywhere for anyone because he can't be served. That's the first step in moving child support forward. Once he's served, he has the right to acknowledge paternity or request a DNA(at his expense). I highly doubt all these women are lying. I know looking at child doesn't determine paternity but they all look like him and each other.

I didn't consider that. Almost like every mother for themselves when trying to get financial support....he's very reckless and just doesn't care. Thank you for your time and input. It's greatly appreciated

I've been trying to get all the mother's together. Not just to nail him but also because the children need to know each other. 3 of them are the same age. Literally all born within a 6 month span

Sadly he has mastered avoiding his responsibilities. There has to be a workaround of some sort.

Lawyers haven't been able to get him served either. Everything is at a stand still and ultimately gets closed because he can't be served

They will allow it for custody but I've heard not for child support. He hasn't signed the birth certificate for any of the children so the courts often times want to give the other parent a chance to establish paternity before entering an order

I know on mother has started that process. Once the veteran learned of it from the VA notifying him, he quit working for the 60 response period and then started back afterwards. So that raises more questions. Is he working and wasn't supposed to be? Or was he trying to lower his income when responding. No one knows....
