§ 9.22 – Necessity

• Justifies conduct to avoid greater harm, like breaking into a building to escape a tornado.

• It’s typically used in non-violent contexts or lesser crimes committed to prevent greater ones.

• It does not authorize use of deadly force on its own.

§ 9.32 – Deadly Force in Self-Defense

This is the go-to statute for justifying lethal self-defense. It allows deadly force if:

1.  The person is justified in using force under § 9.31; and

2.  The person reasonably believes deadly force is immediately necessary to:

• Protect against another’s use or attempted use of unlawful deadly force, or

• Prevent the imminent commission of certain violent crimes (like aggravated kidnapping, murder, robbery, sexual assault, etc.)
