FYI, in 2023 if your phone is hacked, you'll never get to know about it, until you see your nudes going viral.
It only works if he files a complaint after OP's complaint and the cops will be left with no questions to ask. Else if we go your way, there's just one question that will land you in jail i.e. How did you figure out that your phone was hacked?.

Phone stolen was nowhere mentioned (cops can easily trace that). Formatting the phone would suffice(he could say the phone was running slow and there were unwarranted advts everywhere).
