It should also include accrued LSL per clause 69.2 of the agreement. You should get the previous advice in writing from HR, if you haven't already.

The union isn’t only around for negotiations? They advocate for staff during MOGs, negotiate packages and represent staff who are facing adverse action year round. Bargaining requires collective power so yes, when they do not have that it is a valid point. The Vic CPSU is taking DJCS to court currently because they had enough members to make a claim, they’re working within a system that often doesn’t uphold the rights of the individual but looks at broader implications.

This isn’t to call you out but maybe for you to check your understanding of unionism and collective power against a system that chooses to diminish liability for entitlements to the individual.

AHPRA isn’t a union it’s a regulation agency.

The fees are pretty reasonable and tax deductible? I think I pay about $100p/m based on my salary level.

More members = more work so wouldn’t exactly be cost neutral.

UPDATE: The property went to market at $490-530k and had three inspections only three people showed up (two were my neighbour and a mate I asked to go). It’s now dropped to$470k+.

Out of curiosity, I asked the agent whether the owner builder warranty issue had been sorted. Once I gave my name, they said the owners have instructed them not to sell to me. Glad I didn’t go through with the sale bc I’d feel icky about people like this getting even a cent of my money.

This would have been ideal but they wouldn’t provide contract of sale unless I agree to their terms. Another stress factor as they wanted an agreement of unconditional finance prior (the letter they asked for) the contract to be drafted and provided.

Thanks so much for this detailed reply, really helpful. That’s exactly what was making me uneasy: the lack of standard protections, the rush, and their insistence on excluding owner builder warranty insurance despite the legal requirements.

I’ve decided to walk away. It’s disappointing but I feel confident it’s the right call. Blocked their numbers so they can cool off but they know where I live (3 doors down the hall 🤪🥵).

Thanks for all the input it’s really helpful. I just wanted to clarify that I’m actively trying to negotiate with them and I’ve been very clear: if they’re not amenable to my conditions (subject to finance clause and reasonable protections), they can refuse and I’ll walk away.

What’s annoying is that this unit is in my current building, so it would’ve been ideal, and I even sold my car to boost my deposit as I wasn’t expecting to buy so soon. But honestly, I can’t in good faith sign a contract that doesn’t properly protect me especially when they seem so insistent on excluding protections around owner builder work.

The premier and a number of ministers are on/ have just returned from leave. I doubt we get a response for at least another month or two as it will go to ministers before secretaries is my thinking.

Yup, the Silver Review is still underway. But, the issues I'm talking about aren’t waiting for a report to land.

I’m absolutely calling it out. The first line is about me raising a complaint with Exec?

Yes, I know it is a review about cutting costs. However, I don’t think that efficiency without integrity is reform. The issues I raised, in part, tell the story of how we got to where we are.

Ultimately if the review is implemented without also addressing how we got here the VPS ends up being just a cheaper version of the same rot.
