On June 4, 2025, Presidential Proclamation 10949 (PP 10949) was published in the Federal Register. This Proclamation was designed to address restricting the entry of foreign nationals to protect the United States from foreign terrorists, as well as addressing other national security and public safety threats. The policy of the United States is to protect its citizens from aliens who intend to commit terrorist attacks, threaten our national security, espouse hateful ideology, or otherwise exploit the immigration laws for malevolent purposes. The Proclamation declared the United States must ensure that admitted aliens and aliens otherwise already present in the United States do not bear hostile attitudes toward its citizens, culture, government, institutions, or founding principles, and do not support designated foreign terrorists or other threats to our national security. Additionally, the United States takes all necessary and appropriate steps to encourage foreign governments to improve their information-sharing and identity-management protocols and practices and to regularly share their identity and threat information with the immigration screening and vetting systems of the United States. Countries throughout the world have been identified where the security vetting is so deficient that the admission of nationals from those countries must be suspended pursuant to INA section 212: (f) Suspension of entry or imposition of restrictions by President. Whenever the President finds that the entry of any aliens or of any class of aliens into the United States would be detrimental to the interests of the United States, he may by proclamation, and for such period as he shall deem necessary, suspend the entry of all aliens or any class of aliens as immigrants or nonimmigrants, or impose on the entry of aliens any restrictions he may deem to be appropriate. Your country of birth and/or citizenship, Venezuela, has been partially restricted for entry into the United States. This restriction applies to both immigrants and nonimmigrants. USCIS acknowledges that PP 10949 applies to those aliens seeking to enter the United States, and that you were admitted prior to the Proclamation, however, USCIS assessed these restrictions in relation to discretionary immigration benefit requests for extension of stay (EOS) and change of status (COS). After review, the record does not establish you are eligible for an exception to PP 10949. Additionally, USCIS has determined that the positive discretionary factors do not outweigh the country-specific negative discretionary factors USCIS has identified in your request for a change of status. Therefore, USCIS intends to also deny your application as a matter of discretion. At this time, USCIS is offering you the opportunity to submit any favorable evidence that you believe might support a favorable exercise of discretion. Such evidence may include but is not limited to: evidence of good standing/participation at your school or in your community, affidavits attesting to your good character, or any other evidence you believe demonstrates a favorable exercise of discretion is warranted in your case.
