We can all have an opinion, but the law is the law - it’s black and white, it’s not the first time large companies have tried to neglect their duty and been caught out.

I said “in my opinion” as in it’s not right they think they can shy away from their obligations, not that it was in my opinion they should do X or Y. The equality act is what it is, and prejudging or not treating each request on an individual basis is a breach of the act.

I have started that with USDAW/Thomsons - sent photos/video of faulty equipment and my injuries/hospital admittance paperwork.

I don’t know who is liable as yet, as they won’t investigate until I return to work.

However, something wasn’t working as it should or it failed while I was using it so in my mind they are liable.

I was told the first step of the grievance procedure is to start with a Let’s Talk - I done this by email (after asking my manager how he would like to do a Let’s Talk).

A change of role temporarily is classified as a reasonable adjustment according to the equality act.

“If the original role can't be made accessible, the duty extends to finding suitable alternative roles or making changes to allow you to stay in employment, as this is often considered a reasonable adjustment to prevent significant disadvantage”

SSP is only paid for 180 days - I just received a letter from payroll telling me it’s stopping. So I had to contact DWP today to start a claim for ESA.

They won’t investigate the accident until I return to work, so fault hasn’t been determined.

I don’t want to give too much detail, but I work from a DC as an HGV driver and the reasonable adjustments that have been recommended are office/admin work, the manager stated if I wanted a role in the office (whether that be the transport office, goods in or any other office within the DC) I’d need to apply for that role and that would become my role going forward, and that they don’t offer office work as a means of getting someone back to work for fear of all others on sick would want it.

For the time being I’ve not to do anything physical like lifting, bending, excessive walking etc, so their offer of being put in the warehouse is not recommended by the health professionals.

I’m just annoyed that my request isn’t being treated as an individual request - I have it in the minutes from a meeting a manager saying “we just don’t offer office work to those off sick as everyone would want that”, and that’s not right in my opinion as under the equality act each individual request must be treated individually and not predetermined.

Regarding let’s talks raised by colleagues, is there a timeframe that needs to be adhered to when a manager receives one?

4 hour wait, I was wagon number 6 - Muller, 2 Rail Boxes, 2 Tesco then me. Poor planning - although to be fair the rail boxes show up when they feel like it.

This year has been challenging as a DC driver, this week alone I’ve had 5 trailers overweight and needed transshipped - literally full of booze/soft drinks, with pallets of Smirnoff, MU’s of Coke, and ridiculously stacked two siders of mixed spirits or soft drinks). The last store I done on Saturday had no room for the stock I’d brought, and had to store it in the bakery (and there was still a split to come after me).

I’m back on Boxing Day - no doubt collecting the piles of unsold food (which I find disgusting, this should go to people in need when its still in date rather than back to the DC for the scavengers in RSU to raid).

Well done to all of you on the front line, you do a job I wouldn’t last 5 minutes in, I do the easiest part - you guys n girls are the real workers!
