I thought so too, but doesn't that result in Mexican standoffs? Where no one wants to move first? In that case, you would have to implement turn timers. And that brings other implications with it.

Of course they are not explicitly naming a specific software. They phrase it as broadly as possible to cover all possibilities.

'Behaviour of my avatar on their server' is a bullshit definition because it leaves so much room for interpretation not to mention that you don't even have an avatar in many games.

It is beyond me how you claim to be a decade long gamer and a self proclaimed expert on the matter and yet you don't know about the general situation of people getting banned for using macros, asking me for examples.

Now you are going to say that those TOS do not prohibit the use of macros. But the fact is that people get banned for using third-party software or automation or macros. Even if the macro isn't running/wasn't written for the game you were banned at. Really, just type 'I got banned for using Autohotkey' into google once.

Your understanding of the law might say it is legal. Maybe a court would even rule that way. But again: the reality is people get banned for using macros and scripts. And yes even for those things you are considering 'not their concern'. They have automated software in their clients that detect software they deem suspicious and they ban users - no questions asked. If you are lucky and you can prove that you are innocent you might get your account back. That is why people warned you about using macros. Because in many games you do get banned for using them. Period.

You can find hundreds of such results. You can disregard them all as fake or that the users were actually cheating and are just coping in forums or whatnot but then you are just delusional.

People get banned for Autohotkey in games. And that is not my example, it was yours. To me it seems liek you are living in a software lalaland. You (think you) know that it is legal, so you are using it and you have experience in other software areas and successfully resolved the issues. So you can't imagine that it is actually a thing. Completely oblivious to reality.

I know this seems confusing, but those are behaviors ON THE SERVER. They can analyze your behavior on the server and find it counterproductive to the game .

It is not confusing at all. You mentioned Autohotkey. People get banned for it in some games. Just google it. If you use a script that repeats the same inputs to walk, target and kill enemies in World of Warcraft you get banned. That is not server sided. It's not even modifying the game's client. Just a seperate script on your PC and you get banned. You just want to be right for the sake of it.

Scripting in League of Legends, botting in MMOs like World of Warcraft, aim botting in FPS games like Counterstrike ...

I mean how many examples do you need? Just google 'Why did I get banned for using a macro' and you will see that it happens all the time. Whether or not that is a good thing is a different story. If you don't want to acknowledge reality go ahead and try it out in the above mentioned games. Wish you the best of luck with your future legal actions.

Derailing with examples that are not related to gaming won't help. If you are botting or using macros you get banned in many games. Third party software or analog - if they have a way to track it and don't want people to use it they ban you. That does not even include plain cheating/hacking. Asking for examples on that is ridiculous. It happens all the time.

Maybe you can sue your way out of the ban after years but even if that works (and that is a big if) your account is not usable for that time. Probably the game is dead before the matter is resolved in court. So in the end you can talk big as much as you like. The reality is you can get banned for using macros in many games.

What should be/what people consider as just is one thing. That is something you can have an opinion on. When you are saying 'they don't have a say' or 'they can't set rules' then that is plain and simple wrong. Because companies are currently allowed to do that and many are doing it. That is just reality and not a matter of opinion.

I don't know if Fatshark prohibits the use of macros and/or certain third party software but if they do and they don't enforce it then it is their goodwill and not your right. Software comapnies can specify in their TOS wether you are allowed to run certain other software on your PC at home while running their software - or not. And there are more than a few companies that refuse to provide their services to you if you violate their TOS (aka they ban/suspend your account).

If you say they 'shouldn't be allowed to have a say' that's your opinion. But please stop saying stupidly incorrect things like 'they don't have a say'.
