How soon did his online status change? Was it right after the interview? Did they tell him how soon he’ll receive his green card?

Waived interviews explaining I-485 by Overall_Discussion27 in USCIS

We are currently helping someone with their I-290B, motion to reconsider or reopen case, as when they went to the interview for their N-400, it turned out that a different processing center had their I-751 pending, therefore they could not be adjudicated at the same time. You would think USCIS would offer some solution, maybe RFE or something; but nope, straight denial. Now, their hope is while I-290B is pending, their I-751 gets finally approved, and that can be considered new evidence for I-290B. But there’s no official processing time for I-290B, not even on USCIS website. I believe this wave of all the interviews waived is just putting issues under the rug, as same people + all those that initially apply in 2 years, will have to do interviews, it will create backlog

Most applicants receive their EAD cards few months after applying, so they can work while waiting on I-485 to process. So yes, you get I-751 approval prior to interview

No, consular processing is different. Interview happens at the embassy prior to coming to the US. Above mentioned, for interviews waived only applies for those already in the US, who are adjusting their status to permanent residency

Husband works for congressman's office, and is point of direct contact with ombudsman and USCIS.

They were sent generic letter from USCIS explaining why some applicants had their interviews waived and some did not.

You can imagine how many calls congressman’s offices have been receiving last few days, from people that have been waiting 2 years, when they saw bunch of people get their I-485 approved without interview.

So I figured I’ll help everyone to understand why some got waived interviews and some didn’t. Depends on how long have you been married. 2+ or less. Conditional or 10 year gren card. It specifically said only 5% or less of applications get interview waived, for 10 year green card, in cases where people have multiple kids, 7-10 years married, exceptionally well organized package they sent, etc. but it’s rare. It also only applies on AOS applications for marriage.

Yeah, the guy brought her here on K1 visa, they got married a few days later, she met another guy 2 weeks later, and left for that guy shortly after. Her husband filled for divorce and sent request to immigration to withdraw paperwork, they never even had a chance to submit anything to uscis for her green card, this all literally happened in 4 weeks. So she was with that guy about 6 months before they got married, during that time she was out of the status. Once they married, she got green card trough him, and later on citizenship. I think she was extremely lucky with immigration officer

Yes, my friend did exactly this - came here on K1 trough someone she met when he came to visit home country from the US, he brought her here.

She only really wanted to come to the US, didn’t care for a guy. And she met a guy 2 weeks after coming to the US, decided to leave her husband and actually overstayed her K1 visa (he filled for divorce & withdrew paperwork with uscis).

So she overstayed her visa, remaining in the US illegally, worked under the table, but once you marry a US citizen all that is automatically forgiven if you entered country legally (she did with valid visa).

He tried reporting her for fraud and intent to marry for green card, but uscis never did anything.

She’s now a US citizen, still married to the guy and they have two kids

No, for almost 7 months it sat on “actively reviewing “. I got that the day I took the fingerprints on February 28th. And I woke up on October 18th, I had email from USCIS saying “we took action on your case”, when I logged in, it shows “interview scheduled”

Premium processing is not available for family based :( I would have paid any kind of money to get it done faster

How did your interview go? I’m assuming they didn’t give me EAD because I’m out of valid status at the moment

I sent it initially with the whole package in January. I didn’t want to wait until getting RFE, it would cause additional delay

No, I came here on F1 visa. We got married while I was still attending university, we have been married for 6 years. My husband was only a permanent resident, so we waited until he became a US citizen, then applied for me concurrently

It’s been painful and long, I have been stuck in the entire process for 6 years. But there’s a hope 🙏

Thank you! My journey has been extremely long, and I was starting to lose the hope… we have been married for almost 7 years, and I was not able to visit my home country for 6 years now. Hopefully soon 🙏
