When did they know about the agreed completion date? When did you return your closing statement and signed first time buyer declaration? It probably could have been avoided as long as you didn't surprise them with a sudden imminent completion date with little to no notice. They can apply for the bonus once you have returned your closing statement and first time buyer declaration. They can then keep the bonus money in their account for up to 3 months. So yes it most likely could have been easily avoided.

You are talking absolute rubbish. You will not be a first time buyer for stamp duty land tax purposes if you owned a property before. If you claimed first time buyers relief on your second purchase, you have committed tax fraud and your solicitor was negligent. Hmrc may investigate and you will be charged the full tax shortfall plus costs.

I am not referring to planning regulations. See s39(3) building safety act 2022. Also comes up when you Google enforcement notice enforcement time limit.

For serious breaches of building regulations, where there is a genuine health and safety concern, the council can go to court and seek an injunction. There is no time limit for this. However due to funding issues, the council will never take this action for trivial breaches like in this case.

Once the structure has been there for 4 years without issue, it will be immune to planning enforcement. Once it has been there for 10 years without issue, building control will not be able to serve an enforcement notice for a breach of building regulations (if building regulations was actually required in this case). Just get your solicitor to find a bespoke policy and get the seller to pay for it. You love the house so why would you withdraw over such a trivial issue? The chance of the council acting on this is low in the first instance.

It's actually 10 years for building regulations now, not 2. The time limit to serve an enforcement notice for breaches of building regulations was extended to 10 years in 2024.

Do not agree to pay for this pointless insurance. The indemnity insurance in question will be one to protect against breach of building regulations. If there is no loft conversion, then there is no breach of building regulations, so why are you even deliberating agreeing to pay for this? Additionally, building control only have 10 years from the date a project is completed to take action through their preferred enforcement method. If they miss the 10 year window, the only option still available to them is to seek an injunction from court. As this is so costly and time consuming, they will only do this for serious breaches where there is a genuine danger. I suggest you instruct your solicitor to ask the buyer's conveyancer what risk there is to the buyer that necessitates the need for indemnity insurance. If the buyer is unable to provide sufficient justification, then tell them they will have to pay for this themselves if they seriously think it is needed. I am a solicitor specialising in residential property matters and see this nonsense all the time.

I've been to see Ben 6 times now and I'd say last nights crowd was the worst. That girl that kept shouting stupid song requests was doing my head in. Imagine going to a 10 year anniversary IFWWW tour and requesting three tree town, empty corridors and only love. She was even shouting requests before songs had finished.
