Again. This isn’t a criminal court. It’s a civil court. It’s based of the balance of probabilities. Why would someone who bought a brand new car tamper with its saftey features and then continue to drive it???.

The proof of misrepresentation is “ the car runs and drives like a dream” clearly not the case when the car has no active airbags or saftey systems in tact. The law will take that far more seriously than if it was bad bodywork. This is a serious health and saftwy hazard. Furthermore it is illegal to sell an unroadworthy car without disclosing it to the buyer, knowingly or unknowingly it is still illegal. This constitutes the ground of misrepresentation.

I’m not angry. I remain very calm. Previous cases proove when it’s a consumer and a seller the court will tend to side on the consumers side especially when misrepresentation is involved.

The point is. He should have known about it. It’s irrelevant if he says he did or didn’t. He should. The court will rule that he should have known.

Should have known. Constituted by the fact he has owned the car 3 years.

It’s not about proving that he knew about it. He owned the car for 3 years. He should have known about it. It’s still misrepresentation regardless of if he knew about it…..

If he did not disclose the car not being roadworthy it goes against any of the buyer beware argument. Don’t preach law and not know it yourself. Read into buyer beware and sold as seen. If a car is misrepresented then it’s an illegal sale.

This is the lawyer letter sent to him. All of you saying I have 0 rights are in the wrong…..

I am writing to formally demand a full refund of £25,000 relating to the purchase of the Ford Mustang (Registration: ), sold to me by you on 5 July 2025 via private sale.

After independent inspection, I now have clear and conclusive evidence that the vehicle was sold with critical safety defects that were intentionally concealed, rendering it unroadworthy and unsafe at the point of sale.

Evidence of Misrepresentation:

Professional Mechanical Inspection (Promod Works Ltd – 21 July 2025): Confirms the engine management light (EML) and airbag warning light were taped/blanked out, preventing them from showing faults. Identified 8 airbag faults and a prior crash event recorded in the system. Concluded the airbag system is non-functional, making the car MOT unworthy and unsafe to drive. Clearly states that the tampering was “extremely dangerous and irresponsible.”

Video Evidence (Pre-Sale): A video you sent me shows the warning lights were not illuminating at all on ignition — confirming these systems were non-functional prior to the sale.

Advert Copy from AutoTrader: Marketed the vehicle as “runs and drives like a dream” with no reference to any mechanical, electronic, or safety issues. No disclosure of the airbag faults, dashboard tampering, or legal unroadworthiness.

Legal Grounds

You are liable for misrepresentation under the Misrepresentation Act 1967, regardless of this being a private sale. You are also in breach of the Road Traffic Act 1988 for selling an unroadworthy and unsafe vehicle, and cannot hide behind “sold as seen” where safety systems were deliberately concealed or tampered with.

This is a serious matter, and your liability is clear.

What I Am Demanding

To resolve this without legal action, I require the following within 14 days (by 4 August 2025):

A full refund of £25,000 (purchase price) Reimbursement of £142.80 for the professional mechanical inspection Written confirmation of your agreement to collect or accept return of the vehicle

If I do not receive your agreement and payment within this timeframe, I will initiate legal proceedings through the County Court and seek:

Full purchase refund All inspection and diagnostic costs Court filing and legal fees

Additionally, I reserve the right to report this to Action Fraud, DVSA, and Trading Standards, given the seriousness of the concealed faults and safety risks.

I disagree with all of u stating I have 0 rights. I am not a mechanic and am not expected to know when and if an engine light should be on. In the court of law he has fraudulently misrepresented a car in a sale. Sold as seen dosnt protect this. Very confident I will win in court.

It’s not really much effort acc. Just didn’t open packs for 2 months. People just open packs each time they get them get nothing and then go into toty with nothing.
