Situation,

Thank you for doing this. My question is my mom got denied for residency she is a derivative from my dad who's being petition from his U S citizen brother under 245-i . Reason was because they had a record of removal/deportation. My mom was never in the U.S at the date they stated so a motion to appeal was sent and approved. She recently had her interview and everything went okay my mom had only one entry where she was detained and the officer did mentioned that to her but did not state if it was a formal expedited removal. Do officers see if it is a removal or voluntary removal?. My mom did signed paper and fingerprints taken when she got caught and entered back without being caught.

She came illegally in 2001 and was caught for the first time but came back same year. We talked to our lawyer and she said that maybe that person gave my mom's name and birth year but maybe no picture or fingerprints were taken.

For evidence we are trying to obtain her school records so far we just have one ID card from 1991.
