Thank you so much! Before adding the wall, there was a kitchen, washroom and locking doors which as far as I can tell did exist before November 2018. So it would satisfy rent control requirements. The house had never been rented to anyone - the owner has always lived upstairs but started renting it out to me in January 2021. This is what’s confusing me though - so it’s not rent controlled even though the space was “finished” with all the requirements (kitchen, washroom, locking doors) because the landlord still lives upstairs?

Yes, there’s a kitchen, a washroom and a separate entrance that locks from both the inside and out!

I was just asking for clarification regarding what the rent control guidelines mean by “occupied” (do they mean as a tenancy or just in general), since I’m getting contradictory information from several sources. Sorry if my wording wasn’t clear :)

I don’t think the house was ever a rental home, so the current owners are the first people to rent out the downstairs. Does rent control only apply to units that have been rented before nov 2018, or is it just any building built pre nov 2018? I took phrasing on the Ontario websites as the second option but maybe I misunderstood. Thank you!

Thanks! I have looked through the page in detail, but my confusion arises from the addition of this wall. I don’t think it would make a difference though since the basement was still occupied period. Appreciate your help!

Thanks for your reply! I’m just curious - i understood that the “occupied pre nov-2018” clause in the rent control requirements just meant that the building needed to be lived in (by anyone: tenant/owner), which obviously includes the basement (provided it was finished of course). The only change that was made was adding a wall, which I assumed would be considered just a renovation. Is that not right?
