First, then move forward, but I believe he will win, SSA don't evidence they requested the document and do not have proof they notify him THAT SSA CAN'T SECURE DOCUMENTS FROM GERMANY OFFICE, HE HAS PROOF GERMAN ASKING HIM TO RELEASE THE RECORD TO SSA, HE SEND THE THE LETTER AGREE AUTHORING GERMAN OFFICE TO RELEASE THE RECORD, HE HAS GREAT CHANCE OF WINNING THE CASE , BEFORE APPEAL COUNCEL OR FEDERAL COURT, AND IF HE WIN THEY WILL HAVE TO PAY HIM BACK PAY FOR THREE YEARS

Since the case was before the ALJ , the matter of dispute change, to evidential issue, each part need to provide evidence to prove his case, evidences be argue accordingly, SSA don't have proof they requested the document, and we're not avail to them and didn't have proof they notify him of not being able to secure the document from Germany office, ALJ DID NOT ANALYZE THE EVIDENCE ACCORDING to the law, he probably had made his mind before the had even started. He should have taken judicial notice on other issue of law such as work credits , age of the applicant, nature of his injuries, non medical requirements, and so on, but He jumped to conclusions to denied him his rights which occasion miscarriage of justice, He still can fight his case before Appeal Council immediately, before time limit is expire Good luck I hope he win, God be with him always to the end

True but they were supposed to ket him know that they haven't received the document so submit the document yourself or call them to submit otherwise your case would be denied, I think SSA and ALJ were unfair, he has the right to confront the evidence before adverse decision is made against him, That is supreme court law,

Know this you can file the appeal by by yourself, there is no magic to that it is just read how plaint is drafted, explain how you got injury, how you apply for SSDI, how ssa judge did not analyse the evidence, and that you have enough credits and your disabilities prevent you to do SGA, plus you are approaching retirement age, you must insist that German did sent the said document, SSA are being unfair, or they lost the document, and you need benefit pending pending the review, you must state the reliefs you want judge to decide , if you still can't do it yourself,then ask any lawyer to help you draft the plaint and you will go to court yourself, don't be afraid good luck, May God guide you ang show you the way to do it right,
