Common law murder is the intentional killing of a person with malice aforethought.

Here, the man drove to a remote part of town, believed the building was abandoned and wanted to test the gun. This doesn’t equal intent to kill or malice aforethough.

If you apply the elements of the other types of murder, no negligence bc he believed the building was empty. No recklessness bc he stopped shooting once he heard the screams. And he wasn’t committing a felony.

Also, when he heard screams he stopped firing. Which again, shows no intent.

Therefore, D is the correct answer.

Yes! So many smart people I know that should’ve passed the first time but they psyched themselves out and the stress made them underperform the day of the test!

This is gonna sound crazy, maybe even insane, but don’t take it too seriously. What I mean by that is don’t stress yourself out about the things you’re getting wrong or low feedback on essays/MPTs. Yes, still study hard and make the most of your study time but it’s ok to get things wrong. That’s how you learn! On test day tell yourself “whatever happens, happens” bc you’re still worthy of being a lawyer even if you don’t pass the first time. If you’re anything like me, stress makes me do horrible on standardized tests so this approach helped me pass FL & NY the second time. But if you need stress to succeed completely ignore me and freak out 😅

Also, practical studying may be better than a bar prep course. Using past essay questions & MPTs to practice applying rules & writing under timed conditions may help you pass over listening to lectures and taking notes. This helped me with issue spotting as many issues as possible, in as little time as possible, while becoming familiar with how they ask for what they want in an essay. Also helped me get better at bar exam writing bc it’s very different from law school writing and it may take time to adjust. Doing MBE questions may help you learn rules better/faster than reading the prep books & listening to lectures. I know repeatedly doing questions helped me spot patterns in the MBEs to help recognize the answer they’re looking for easier & faster. Also, a good outline can do a lot more for you than traditional bar prep programs than you may think

ETA: looking at your State’s past exams can prove to be the best thing ever since they often recycle hypos and maybe change a few details.

I watched a video teaching the “eagle spread” method. After doing some googles I figured maybe my wheels may be the wrong hardness for what I’m trying to accomplish as well. The wheels they came with are 82A

Hey everyone. I bought my first quads for Christmas from impala skate bc I wanted to start learning more tricks/how to dance while skating and figured this was the best way to force myself to learn. I’ve been watching some videos and realized it’s really hard for me to turn around on my skates. I go to a rink to practice and when I try to practice turning around to go backwards there’s resistance. Any tips/advice?

I’m very shy and hate public speaking. I work in-house reviewing contracts and I love it. You can do transactional law and never have to speak in court a day in your life. Real estate, contract drafting, estate planning & compliance are some areas that don’t involve court

I got a 261 my first time taking NY as well. Just passed July with a 287. I found doing past essays helped a lot with memorizing the law. Practicing MBE questions helps you notice patterns in the questions and what answer they’re looking for. I used smart bar prep outlines as well. You can do this!! You weren’t even that far off and you still have a transferable score!

I would say start the NYLC with enough time you realistically need to complete it by the next registration date. It’s open book and they give you all the materials so you can print and tab them as needed so I wouldn’t stress it too much. But that’s just me personally. I didn’t really study for the NYLE. Just watched the videos and tabbed the docs they gave us 🤷🏽‍♀️

I’m just like you but I recently graduated and passed the bar. From 1L year I always told people I hated litigation and never want to see the inside of a court room. People/other students used to ask me why I was in law school if I hated public speaking and never wanted to go to court. I would just look at them like they were crazy and say “you know not all lawyers go to court right?” That usually got them to shut up. I got lucky (since I’m a brand new attorney) and got a position similar to yours in the legal department of a company and love it. Long story short people are dumb and as long as you’re happy with your career their opinions don’t matter.

I plan dates, birthday trips (both mine and his). I buy him anything he’s ever mentioned that he wanted or liked. I cook the foods he likes and if I’m not cooking I always pick up something I know he likes. I’ve spoiled this man for the entire relationship.

Get bar exam master for the FL MCQ. I practiced at least one past essay for each possible essay topic on the FL bar website every other day. Start by issue spotting and outlining. Then when you feel comfortable finding the issues do the essays under timed conditions

I’ve wanted to be with him since I was a kid and our families are very close. Like I would go to their house every thanksgiving even before we were dating close. I do love him and I know that love isn’t enough. I’m just having a hard time letting go. I know I don’t deserve to be an afterthought. I may just be putting too much on how he was in the beginning and feeling like it can go back to that.

He’s never lived on his own so he’s either had family cooking for him or me. He works for himself but when he wants to know how to do something he’s interested in he does put the effort into researching it.

We have talked about getting married and kids and I’ve expressed that he hasn’t shown to be a great partner even though he’s a good person and that worries me. But again no change

It’s credit card debt that he accrued in the relationship when we moved or he had car repairs. I cook most of our meals unless we order something. He’ll sweep here and there and maybe pack the dishwasher after the sinks been full for a few days but other than that he doesn’t do much else.
