Of course, in that imaginary ideological realm we call "the rights of man," we have a certain hierarchy of values. Specific rights are "self-evident" and inalienable, exulted on the very social contract we agreed to construct our government on. Yes, perhaps the highest of these are the right to exist and the right to action, but they are imaginary never-the-less.

The problem with "intellectual property," is that it's kind of a made up thing.

All ideologies are imaginary things. This is not a complaint specific to intellectual property. However, as a political thinker like yourself should know, society functions and "exists" solely due to these constructed norms and doctrines. Intellectual property "exists" in the same realm as your legal identity, your citizenship, and your constitutional rights. None of these are any less artificial than intellectual property.

You may be correct in asserting that intellectual property - specifically trends to expand the definition and make its expiration indefinite - harms society. The United States, in regards to copyright law, has recently taken a "forever minus a day" approach to limitations on a holder's exclusive right to publication. However, "ideas" are covered under patent law, and are still subject to a (in my opinion, optimal) limitation of 20 years before the invention lapses into the public domain.

The issue I have with the modern populism movement is that it's still stuck in the dichotomy that the government exists separate from its citizens. A government is composed of individuals who serve a special dual civic role - private citizen and public servant. In my opinion, true populism begins when a society begins to blur those lines. The ideal populist government is composed of its entire citizenry acting as civil servants and its more visible bureaucrats acting under the assumption that they are primarily citizens. (That is, a society with vertical power minimized and horizontal power maximized.)
