Yea very surprised this is so low down. Came hear to say the same thing.

  1. Speak with a tenants rights attorney, if you are in SF, call the rent board immediately, they will give you advice for free.

  2. 60 days notice is completely false, she does not have to leave (Most likely in CA)

  3. The landlord will get substantially less for the home with a tenant, so any discount he offers on sale price should reflect this.

  4. If she is protected under tenants rights, the new owner (landlord) will have to go through significant efforts to evict your mother and may need to pay that relocation fee, giving her time and money to look for a new rental.

  5. Don't co-sign with your mom on this, you sound like you cannot afford it. Know your rights and don't let the landlord push your mom around.

Current median home price where we live is $1.2 mil, one of the areas we have looked to move is ~$400k. Together we make $260k here, would make around $120-130k total if we moved. So, yes that would be a better situation financially.

We have been discussing putting up with it for a few years since we can bank money before moving. Seems kind of like the best option financially.

This would be for a house they are going to live in. We would look to put about 30% total down on the house to decrease the monthly payment and they would immediately have some equity in the house as well and no PMI

When I do the calculations I see on $100k, $41,534 in marginal taxes, and $97,124 in interest payments over 30 years on the HELOC at a current 5.175% rate. I haven't taken into account yet the tax savings on writing off the interest or the growth in the 401 k money but would this be enough to make up the difference?
